1. What additional evidence, if any, should they produce to support this submission?
The Ministerial Direction 65 creates the guideline for the legislation towards decision made
towards visa refusal. Visa refusal and cancellation are conducted under a number of regulations.
The person who has been refused of visa approval is not supposed to apply for visa. All they can
apply for is a protection visa. This protection visa shall be extended under the legislative
regulation of s.501E. As the case of Chatura and Asheni is described, it can be stated that they
are in ardent need of approving their visa application to reach Australia to claim their
Contributory Parent Visa. However, it is mandate for them to undergo police clearance
procedures to reassure the application authorities before getting their visa approved. Chatura was
observed to have undergone imprisonment as he was sentenced with 11 months of jail custody. It
was under the act of causing serious injury to his girlfriend at the age of 18 years. It is by far
considered that character of the person is a great precursor to determine visa approval1. There
were sufficient proofs produced against the reason behind his crime committed. There was a
psychological report indicating his instable state of mental health which triggered him to act in
that manner. He was also suggested anger regulation and control session as the judge had
confirmed with the medical condition forming sufficient ground for his act rage. However, it is
widely suggested that character is understood to form a major ground for conforming visa
