Question 1
Case Study Analysis
In terms with the case study which is explained in detail is the in connection with Bryant & Stoker Pty Ltd and the
transactions on the Stag Lyons Pty Ltd Superannuation Fund (SL Super). On the more, the case explains the problems in
relation with the Data-Easy Pty Ltd as well as the FI Investments Pty Ltd and the fraudulent misstatement done in
connection by the Barry Van.
a) Looking and Analyzing the case it is evident that the Bryant & Stoker Pty Ltd's legal claim against Barry
Vann is very stronger and dominant. Mainly, while investing in the company both the medical practitioner (Dr
Stoker) and his wife (Ms Bryant) were clear that he will only transfer or make investments if such actions are not
transferred in the amount of SL Super Funds, however, this did not happen and eventually all the amount was
transferred to the Sl Super Funds. The other was made on the factor that the auditors of the company each year
provided the annual report which states that the investment was reflected in cash and not any other form of
investments. The same was mislead of annual report and financial statements as the auditors of the company did
not represent the true and fair picture of the organisation. Thus, the same is not reflected in connection as the loan
and was always reflected in terms of the cash. Henceforth, all the elements lead to a possibility where the though
the books of account were showing another picture, the real picture was showing a different position which was far
different from the books of accounts (Chalmers, Hay, and Khlif, 2019). On the more, it is necessary to understand
that the audit report made was incorrect as such errors must have led to issues which must be qualified however ,
the report presented by the auditors was unqualified. This led to a major breach of actions in connection to the
auditors along with the element of mistrust and also a motive which proves to malice and fraudulent.

Adding more, to the same it was evident that when repeatedly the funds were called back the latter did not
acknowledge the same . Thereby, adding more fuel to the fire, as a matter of fact the none of the things were
working and therefore, it became evident that Bryant & Stoker Pty Ltd are prima facie on a much stable and right
position to claim against the auditors Barry Vann in terms with the transactions entire done. Hence, things can get
more complicated as the financial statements are justified and provided in other direction and perspective,
b) The opportunities for Barry Vann to reduce his liability, should he be proved negligent can analyized as
follows and explained in connection with the factor which being the three main and most common doctrines are
contributory negligence, comparative fault, and assumption of risk. The aspect of contributory negligence says that
the Contributory negligence occurs when a plaintiff's conduct falls below a certain standard necessary for the
plaintiff's protection. In connection with the Comparative negligence the liability level is reduced on account of the
factor where the types are managed in connection with the concept of Pure term, modified term as well as the
Slight Gross term (Leitch, 2016.). In connection with the first the liability is waived off and managed in a limited
percentage, where as on the other it is managed on account with the level of negligence and or even the lesser
amount or value. The other aspect which may help in reducing the value is the assumption of risk, where the
damages and the risk is nullified many because of the factor that the risk on ignorance is drafted and the level is
led to the actual subjective knowledge of the risk. Thus, leading Barry Vann to reduce its burden of liability in
respective to claim and payments and damages.
