Facts
Dr. Jekyll had indicated to Dr. Frank that he was willing to buy his (Dr. Frank) if it was brought
to office before noon. The response to Dr. Jekyll by Dr. Rank was stolen and so Dr. Frank went
ahead to buy a bike from Dr. Moureau. Dr. Frank manages to deliver the bike at 11.50 a.m., but
Jekyll is too engaged until it is past the time they had agreed. Frank, therefore, feels that Jekyll
has breached the contract by not honoring the promise though this has happened because the
communication from Frank to show that he is willing to take part in the agreement was not
received by Jekyll.
Issue
Under the United States law of contract, one remains legally obliged to the agreement reached by
two private parties just provided that the agreement is express or implied. This means that if two
people agree on a transaction or they agree to get something done then one of the parties fails to
meet the requirements of the agreement then they have breached the contract and in such a case
there should be compensation or a penalty depending on the court's decision.
Rules
An individual may be liable for breach of contract if they fail to honor the agreements reached in
a given contract.
