ii. Interference with possessory interest; Spray painted walls of the properties
iii. Lack of owner’s consent; although Bieber claims that every property he has
tagged has been approved yet the police has accused and arrested him of
trespassing to private properties
iv. Intent to damage; he spray painted the properties without the owners’ consent

i. Unlawful intrusion upon a property; fans of Bieber intruded in the Faena Hotel
Puerto Madero
ii. Use of force; fans became rowdy and disturbed the hotel guests
iii. Consequent injury to owner; the private properties of the hotel were damaged
iv. Intention to create intrusion; the fans were waiting outside for Bieber and were
reportedly turned rowdy. They had complete intention of creating intrusion and
disturbing the guests.

a. Negligence
i. Duty; As Bieber is the owner of the capuchin monkey he is responsible for the
welfare of the monkey

ii. Breach; Bieber failed to produce required vaccination and import papers to the
German customs during his tour in Munich
iii. Causation; the monkey was seized, quarantined at the local animal shelter where
it was cared for. Bieber refused to keep the monkey anymore. As a result the
shelter might declare the monkey as property of the state and would transfer it
permanently at zoo or any animal park.
iv. Damage; Facts in Support

i. Inherently dangerous or unreasonable act; Bieber was carrying the monkey to a
international tour without proper documentation
ii. Causation of damage; failing to provide vaccination and import papers and
further failed to pay the shelter charges, costs of care, food and vet visits
iii. Actual suffering of harm; for the non-payment from Bieber the shelter’s cost of
care and other charges have increased to several thousand Euros
iv. Liability regardless of negligence or fault; Bieber is held liable for the monkey by
the Munich customs spokesman as he is the owner of the pet.

agreement restricting tweets, texts, calls, facebook, recording or in any

iii. Interference in business to create economic harm; sheriff’s deputies were called

iv. Wrongful conduct; it was said by the neighbors that marijuana was smelled by
the authorities
b. Invasion of Privacy
i. Intrusion upon the intention to be left alone; although Bieber wanted the party
to be confidential yet the sheriff’s deputies were called 3 times
ii. Reasonably offensive; neighbor claims that authorities smelled marijuana
iii. Public disclosure of facts; the facts relating to the party was disclosed to the
public along with the arrival of the authorities
iv. Intrusion in private matters; As Bieber wanted this party to be confidential the
arrival of the authorities and the neighbors’ interference to the private matter
made it an invasion of privacy.
