2PERFORMANCE MANAGEMENT1. Measure to ensure law is associated with Performance Management Programs:Data related to performance appraisal are generally used in making significantdecisions related to HR. The system of appraisal has been a common target of legal disputesby the employees engaging bias and unfairness charges (O’Leary, 2017). Certain measuresare required to be taken to keep the performance management program like performanceappraisal as per the relevant laws:a. Process of Legally Defensible Appraisal:-All decisions related to personnel needs to be based on proper uniform performance systemof appraisal.-All the specific standards of performance need to be formally communicated to all theemployees. -There needs to exist a formal process of appeal for the tempo to rebut rater judgements. b. Content of Legally Defensible Appraisal:-Any appraisal content on performance needs to be based on the analysis of job.-Appraisals that are being based on traits needs to be avoided.-Constraints existing on the performance of an employee that are outside the employee’scontrol should be prohibited from playing an influential role in the appraisal for ensuring theemployee has equal prospect in achieving any given level of performance (Aguinis, 2013). c. Legally Defensive Raters:-The raters require proper training in knowing the use of an appraisal system.-The raters need to have an opportunity of observing the ratee first hand or in reviewingsignificant performance products of ratee.
