The English legal system consists of the common law system that mainly comprises o
civil and criminal law and each branch has its set of own procedures and court. There are three
branches of government and the governance of the state is divided into three branches under the
doctrine of separation of power. These branches has their own roles, responsibilities power and is
distributed with an intent that it will prevent one branch from being supreme and have developed
the checks and balances system in order limit each branch (Rezaee, 2017).
The first branch is legislature which consists of Parliament which has two houses, House
of Common and Lords. The main role of legislature is to enact the laws as per the need in
society. The Parliament is considered as supreme law making authority that enacts statutory laws
which cannot be challenged in any court. For instance, the Theft Act made by legislature.
Another role of legislature is to delegate the power of law making to government by the power to
enact subordinate legislation. It has the power to determine rights, responsibilities and duties of
authorities and individuals to whom the legislation is being applied.
Another branch is executive which consists of the UK government that includes cabinet
minister and Prime Minister and the Crown. It is entrusted with the role to carry on the
administration of country according to the power which is conferred by law on it. Its role is to
initiate and implement the laws in the country and ensure that these are enforced appropriately
and run the national and local services such as police.
The third branch is the judiciary which includes the judges and other officers of tribunals
and courts. Their main role is to develop the common law and has to apply and interpret the
statutory law made by Parliament. For instance, murder is an offence created by common law by
the judges. The judicial branch exercises the scrutiny through ensuring that executive act within
the power allocated to it and can also question the lawfulness of the public body’s action which
includes government ministers and this is done by the procedure, judicial review (Avarvarei and
Dominte, 2017).
The contract is an agreement which includes four essentials in order to make it a valid
contract. The law on this provides for specific remedies which the aggrieved party can claim in
