EXECUTIVE SUMMARY
The Australian property law states the rights, interest an responsibility of an individual.
It prioritize the rights and differentiate property as tangible and intangible. Land law focus on
western property law, legal developments outweigh the development of other property law. This
is primarily because of the higher valuation of land compared to other property. In the given case
there is an agreement made by Amanda to Paul for purchase of house through an agent. Agent
name was Jenny who is Paul's wife. The main issue in the case was that Jenny made
misrepresentation of valuation of property because Jenny has personal interest in purchasing the
property. Amanda want to sell the house because of its high maintenance cost. There was an
electronic transaction between them terms of communication through phone call or e-mails.
According to the case there was an agreement between both the parties but Jenny was acting on
behalf of Amanda to sell the house which a case of misrepresentation. Agent agreement was a
misrepresentation which made Amanda feel betrayed as she found out that the value of property
was £850000 instead of £800000 and she was no longer interested to sell the house. Both the
parties went into negotiation which was beneficial i.e. reduce conflicts, better results, along with
it it has some drawbacks that negotiation are voluntary and having different bargaining positions
may create conflicts between the parties. There are various strategies parties need to consider
before entering in the negotiation such as making multiple offers at the same time, contingent
agreement, negotiation destroy upfront and post-settlement settlement.
