This study analyzes the challenges in trust law, particularly in discretionary beneficiaries, as highlighted in ASIC v Carey [No 6] and other relevant cases. It discusses the extent to which an individual in possession of functional control over a conventional family discretionary trust may be said to have an equitable interest in the trust asset. The study also sheds light on different approaches and issues that arise in regards to trust within individuals and businesses.
