1. Access and list the laws and regulations applicable to early childhood services. (50 words)
The laws and ordinance related to children includes:
Adoption Ordinance
Child Abduction and Custody Ordinance
Education Ordinance
Child Care Ordinance
This helps to let the children enjoy their own right and duty care homes are also assigned where all the employees
need to ensure that they must offer service complied with high quality and work.
2. Identify your legal rights and responsibilities that apply to your work role in the above scenario?

My legal right pertaining to the above scenario is such that I have to identify the children who are at
risk and that is why, it assists to ensure that they are protected in accordance with a law. Moreover, I
also encourage good practices by promoting as well as championing he child protection policy. Also,
regularly report to the management in order to ensure that all the child are at safe place and
appropriate training is also provided to them.
3. A. What would you have done if Emma had hit Adam on his upper left arm? Consider the legal
and ethical aspects of the situation? (100 words)
If Emma hit Adam, I suspend her because the law is breached when an any caregiver hit any
children. It is so because as per the legal and ethical aspect of the scenario, it has been
analyzed that no service giver should allowed any employee if they beat or hit any child, for
that immediate action needs to be taken so that other people cannot do the same mistake in
future. The legal aspect of the situation is such that student only ask with the lady and she
should not react like this because it makes a child screamed.
You are the room leader in the Preschool Room. Today you have a casual caregiver, Emma, assisting you,
who is also your friend. Emma is in her 20s and is from Germany. Emma has worked before in a pre-
school back in Germany. She is now on a one year holiday-work experience in Sydney. Emma has already
done several casual days with your Service over the past month.
You were interacting with a group of children in the blocks corner, when you heard Emma yelling “I am
NOT your Aunty! I told you many times already, my name is Emma!” Turning, you saw that Emma was
standing angrily over Adam, who was sitting at the puzzle table. Emma had both arms on her waist.
Adam, who is 4 years old and of Aboriginal origin, looked shocked and then his expression turned
defiant. He stared back at Emma and said “Aunty” again. Emma lifted her right hand as if to hit Adam,
paused and banged loudly on the table instead with a clutched fist. Adam flinched and started to cry.
The other children had shocked and frightened expressions on their faces. Emma looked at me, her face
red and then without a word, stomped out of the class.

B. Identify work practices that could be improved to meet legal and ethical

In order to meet the legal and ethical responsibility, it is necessary to keep circulate the policies and
let all the employees aware about the policies. So, it can be stated that with the help of this practice,
employees can enjoy the service and children may enjoy the services offered by teacher.

4. A. Explain your decision to inform or not inform the other staff about the first scenario with
Emma. Link your explanation to your ethical responsibilities. (2-4 sentences).
Yes, all the other staff must be informed about the first scenario because it helps to let them know
about the behavior that need to be followed at the present scenario. This assist to determine that
action can be taken by the organization, if the situation is not controlled. As, the action of Emma is
not ethical because government strictly made laws where hitting the children is strictly prohibited
and this affect the brand image of an organization as well.
B. Recognise the conflict of interest, in the above scenario and explain how you would take
appropriate action?
I personally remove from the situation or conflict because Emma take the word personally and this
make her aggressive as well. That is why, at that situation I leave the place and call Emma immediately to let
her remind their own mistake pertaining to it. This assist to solve the problem and then take action because
scolding Emma in front of small children makes her more embraced. That is why, leaving the place
immediately helps me to solve the problem at certain stage by recognizing the conflict of interest.
5. A. How would you use the six step ‘Problem Solving’ process listed below, to improve work
practices to meet legal and ethical responsibilities? (1/2 page)
I. Define one problem from the above scenario
As per the above, the problem is aggression of Emma which provoke her to take action.
II. Think of three (3) solutions for this problem
Do not react immediately
Never take the word as a conflict of interest
Build rapport and be understanding
III. Assess the 3 solutions
Do not react immediately because it helps not to convert the same into a problem.
Do not assume and make judgment immediately because it affects the word, as in the
case of Emma
Show cultural sensitivity
IV. Select the most appropriate solution and explain your choice
From all, do not react immediately is the only and best solution that can be taken in order to
solve the problem of Emma. As she react immediately so she should be calm and listen to
others before reacting.
V. Plan what you will do
Suggest her to make decision accordingly so that it will not affect the behavior and working
environment. Personal meeting can be taken in order to realize her about her mistake.
VI. Act and evaluate. Describe one way that you could evaluate your plan.
To evaluate the plan, I remove the activities and take a feedback from other students in order
to analyze the action of Emma.
B. How will you actively share information with your colleagues on your above plan?
To share the information with colleagues, I conduct a meeting for half an hour where all the staff
members invited in order to let them understand about the situation and ask not to react
immediately. Also, I share the entire incident and propose solution so minimize the chance of such

By analyzing the information presented over problem solving process, policies can be developed such
that in the case of Emma, policy is developed where organization has to comply with employment act so that
the child cannot be hit by any employers. If such found, then individual is arrested and compensated the same
according to the defined penalty in laws.
