 In the courts of Australia adult offenders
are punished with life imprisonment in case
of heinous crime.
 If jury finds out that defendant has been
found guilty the in this case judges decide
over an appropriate sentence.
 In this Magistrate can find defendant guilty
and pass the sentence or can also send the
case to crown court in case when offence is
to serious.

In Victoria, most people charged with offences plead guilty. If someone pleads not guilty,
there is a trial or a hearing to decide if they are guilty. If a person pleads guilty, or is found guilty
after a trial or a hearing, the court decides their sentence. In the Magistrates’ Court, sentencing
usually happens on the same day that the person is found guilty. At that time, the prosecutor (a
member of Victoria Police) and the defence lawyer (or the offender if they are representing
themselves) will provide information to the magistrate about what the sentence should be. In the
County or Supreme Court, after a person is found guilty, it may be weeks (or even months)
before a separate hearing (called a plea hearing) is held to decide the sentence. During this time,
a pre-sentence report may be prepared, containing information about the offender that the court
needs to consider when sentencing. At the plea hearing, the prosecution (a lawyer acting for the
State) and the defence (a lawyer acting for the offender) will provide information to the judge
about what the sentence should be.

Explain the main differences between, the management of adult offenders’ frameworks
and models used in another Australian state or territory to those used in Victoria,
regarding sex offenders.
Australia has followed the course taken by other English-speaking countries in recent
years of enacting legislation that requires convicted sexual offenders to register personal details
with law enforcement agencies. These laws have been enacted to protect the public from the
perceived threat posed by sex offenders, but have been written with little apparent reference to
the available research literature about the nature and extent of this threat. In addition, there is no
empirical evidence supporting the effectiveness of legislatively based sex offender registries to
either reduce sexual offending or to enable the police to investigate sex crimes and apprehend
offenders. This article compares and contrasts the current laws governing sex offender
registration enacted by the various states and territories in Australia, and offers a critical analysis
of their provisions in light of the research literature on sexual offending.
