1.0 Executive Summary
In this report the analysis will be related to the perfect procurement selection
systems for the park project related to environment and also provide a comparison
of the contract on how to deal with the problems of timing, costing and also quality
related parameters. In addition to all of these this project is also selected to
understand the relationship between the supplying chains and the schemes related
to partnering for any kind of future projects and also develop the techniques for
stakeholders related issues.
The intension of the client is to do the project as the cutting-edge sustainable
development, and also implement best and the most innovative and updated
practices.
Requirement of the project, the constraints, dangers, and the capability of the client
and the marketing position was analyzed in order to determine the perfect system of
procurement and also show a comparison between various delivery models such as
traditional, build and design, directly managed , alliance and many more in order to
identify the most appropriate model for the project related to enviro park. The necessary
steps and approaches to the market include the tender processing , pricing strategies
and the contract form were analyzed.
The designing and the build structure were detected as the most appropriate approach
to get the opportunity to the employer in order to select a appropriate design by quality
maximization within the budgetary constraints and also to proceed with a continuation of
the designing effort. Further the clients are preferring to remove all the inefficiencies and
the delay related to the preparation of the designs and also to speed up the project in
order to get the best value related to the return on the investment, transfer the
responsibility of the contractor for a large fixed pricing and bespoke designing, and also
utilize the technique in order to select a perfect design to establish a landmarking
construction and also to immediately commence the projects. The most common type of
contacts like the FIDIC, JBCC2000 , NEC3 and the GCC are compared among each
other in order to find the most appropriate form on order to make the contract. After
comparing all the contacts, the FIDIC Yellow Book- Conditions is chosen in case of the
Plant and Design-Build for the electrical as well as the mechanical plants and also for
building of works that were planned by the service contract taker. In the recent module
of the contract the saying “electrical and mechanical works” moves away from title of the
assignments and which is aligned with that of FIDIC suite and attention is much on what
is the procurement type rather than the nature of the work.
The relation between the supply chain and also the schemes that is related to
partnering were evaluated that was based on the long duration commitment that
embraces the business philosophy that was basically described with the help of the
elements of the mutual trust, long-term perspective, communication, solving of the
problems, mutual targets and also the equity. As all the clients are eager, so that they
can expand their portfolio and are also searching for two different potential sites that are
under development of similar kind of nature in the country of Sri Lanka, it is very

essential to keep a focus on the relationship between the supply chains and also the
partnering schemes to achieve high cost, time benefits as well as quality.
Identification of the stakeholders who are involved in the project, and to set up a perfect
coordination and also facilitation in order to manage their prospects by applying a
practical approach starting from the initial stages of project were illustrated. By
identifying the possible threats and then taking the necessary approach which will be
resulting in the delay of the project is very important in order to avoid any kind of
unnecessary delay. Before setting up the time line the project management team should
analyze these factors.

For the purpose of engineering and the building works of the relatively smaller capital
values, the Short Form of the Contract is recommended. The Leadership Minutes for
the Green Book recommends will not be considered for on schemes having a
commerce value that is superior than US$500,000.
Red Book- The contract of the conditions for the structure and the Engineering the
whole thing that is basically calculated by Employer First Edition 1999
Red Book supplies a condition of the agreement for the building works in which the
designing is approved by the Employer.
Red Book is not considered to be appropriate for any kind of use where the works
are designed with the help of the Contractor and for that kind of the projects it will be
perfect for the Silver Book of the Yellow Book.

The Yellow Book is used to provide a contract for the construction related works
where the designing is carried out with the help of the contractor in accordance with
the requirements of the employer that basically includes an combination of
mechanical, civil, electrical and as well as construction related work. The Yellow
Book is able to bear smaller resemblance of that f that of the predecessors. In the
current edition drops words “mechanical and electrical work” from title and also in line
with all the rest FIDIC suite which focuses on the type of procurement rather than the
working nature.
Project Administration and also the works of supervisors is basically carried upon
with the help of the Engineer those are employed by Employer.
A vital area of the consideration with the preparation of a particular condition is
considered to be the risk allocation for the grounding conditions which proves to be a
danger in the standard draft.

PLANT AND DESIGN-BUILD CONTRACT SECOND EDITION (2017 YELLOW BOOK)
The Second Edition is basically build for the FIDIC Yellow Book with consists of the
FIDIC’s fundamental principles of the balanced sharing of risk which seek to build on
considerable knowledge from use for the historical 18 years. The publication delivers:
1. Clarity and details regarding the necessities for the posters and also other
infrastructures.
2. Necessities related to the addressing of the Employers and the Contractors that
basically claims the treatment of the equally and separated form of the disputes.
3. Provisions related to the management of quality, and also the confirmation of the
Contractor’s pledged acquiescence.
4. Mechanism for the avoidance of the disputes
Silver Book - Conditions of Contract for EPC/Turnkey Projects
First Edition 1999
The Silver Book is basically used for certain processes, private-infrastructure and
also power projects where the responsibility has to be taken by the contractors
for the designing and the execution of the projects. Cost, quality and completion
of time related issues has to be managed by the contractors and in this case
Silver Book provides to be perfect for the experienced Contractors who are
familiar with the risk management approach.
Silver Book basically requires Contractor acceptation in a higher level of the risk
that is considered to be difficult in most forms of the contract.

The technique that DBO contract follows is quite similar with that of the FIDIC
Silver Book than other contracts in the FIDIC suite. Under this contract the
contractor of the DBO do not have any responsibility for the financing of the
project or for the ultimate commercial success.
For the contracts that are traditional DBO sequence based, DBO contract is not
recognized to be suitable or the Operational Period differs from 20 years that are
adopted. (Source; http://docplayer.net/21472350-The-fidic-suite-of-contracts.html)

and the possibility of reduction of the cost of the contractors able to design
the specialist contractors, suppliers and the sub-contractors.
4. Building and Design of the Contractor, enables different designing for the
users for the satisfaction of the employer and is also based on the designing
specialist elements at a very low cost than the professional consultants.
5. Employers or the contractors will be able to utilize the design by selecting the
opportunity that are built on the landmark project in order to promote the
business related targets and also to get attractions.
6. As the requirements of the client are finalized, the project will start
immediately after the evaluation of the tender and also as far client
satisfaction. Consultant of the Client can be able to do the necessary
negotiations with the contractors at a post tendering stage in order to fit the
budget and also designing satisfaction.
7. In case of any quality shortfalls or in case of the inexperience of the client the
contact administrator will cover it.
8. Only the single contractor will be able to lower the cost and the time related
to the project responsibility.
9. Designing and the built will provide the opportunity to the employer so that
they can select a suitable design by maximizing the quality with the help of
the budgetary constraints and also there is a continuation of the designing
effort.

Contractor’s roles and the responsibility
a. Contractors has to comprehend the artistic or the construction values in order to
ensure the high excellence production
b. In this method the responsibilities is in the contractor side, contractor has to do it in
order to accomplish the necessities of the employee within the period and in the
economical as well. Any kind of delay or something that is beyond the control of the
contractor would prove to be a risk for the contractor.
As the trust related to Energy have many years of the involvement in this
