Solicitor- Good morning, Mr. Walters. Welcome to ABC firm, one of the best law firms in this
area. I am (name) and would be assisting you in finding a solution for your problems. Please
come with me inside where you can be comfortable to talk to me about your problems.
Walters- Good morning, Mr. (name). It is a real pleasure to meet you. As you already know I am
Francis Walters. I am a 55 year old man and I live with my wife, Gloria and have been the sole
income earner for the both of us for the last 34 years since our marriage.
Solicitor- That is nice to hear. I should ensure you before our conversations start that the first and
foremost policy of our firm is to ensure that any information shared to us by our clients are
handled with utmost care and confidentiality.
Walters- That is very assuring to hear.
S- Are you comfortable with this setup Mr. Walters? Or do we need to arrange something more
accommodating to your needs?
W- No, please do not bother so much. I am really comfortable in this set up. Thank you for
asking.
S- Ok then let us start our discussion then. Please tell me elaborately what are the problems that
have been concerning you, so that I can look for appropriate solutions for you.

W- Sure. As I already mentioned that I am a 55 year old man and I live with my wife, Gloria. We
have been married for last 34 years and have no children. I have been the sole bread earner for
the two of us since our marriage. And now I am getting old and have a mortgage for the house
me and Gloria have bought together to pay for.
S- I understand your dilemma but to assist you I have to know exactly where your problem lies.
Can you understand me Mr. Walters?
W- Yes, I understand that and I will tell you what my problem is.
S- You seem very distressed. Do you need some time to calm yourself? If you do we can take a
break.
W- No it is fine, I am fine. Let’s just talk about the main problem. The problem is that the
company I have been working since last 34 years has fired me from the job because I am getting
old.
S- That is really sad to hear. But can you please elaborate on what grounds were you fired?
W- I told you why I was fired. After working in that company for the last 34 years I was called in
by my boss who handed me a one week notice stating that I am getting old and cannot give as
much production as I was giving for the last 34 years.
S- A one week’s notice?
W- Yes.
S- Were you paid all your entitlements?
W- No that is the main problem. I was not paid any of my entitlements.

S- How can they not pay you your entitlements? On what grounds did they hold your payments?
W- My boss told me that as I was getting old I have done many mistakes in my work and as a
result the company has suffered losses. To compensate for the losses they would be holding all
my payments.
S- Mr. Walters are you aware of the laws we have for the protection of the employees like you in
our country?
W- I have a very vague idea. That is why I have sought your help.
S- Then let me tell you that your problem falls under the provision of the Fair Work Act 2009.
And under this Act you would be eligible to file a unfair dismissal remedy if we can prove that
your was in breach of the provisions of the Act.
W- I would like to file the application for the dismissal and I want your help in this matter.
S- There are certain documents we would need for that. Documents related to your work, the
notice you were given, the termination letter.
W- I do not have those documents with me today. Can I bring them tomorrow.
S- Of course you can.
W- Thank you for your help. I will see you tomorrow with all the necessary documents.
S- It was nice meeting you Mr. Walters. See you tomorrow.

Real Estate Agent- Good evening to you too. I am (name). I have never seen you before. Can I
know who you are representing?
P- I have come here as a representative of ABC law firm.
R- Are you a new solicitor in the firm?
P- No. Although I am new to the firm, I am not a solicitor. I work as a paralegal in the firm.
R- Do you know Mr. Lee? He is also a solicitor in the firm.
P- Yes I work under his supervision. He has sent me here today as a representative for the firm.
R- I am guessing that you also specialize in the real estate laws as your senior is a well-known
real-estate solicitor.
P- Yes. Here is my business card if you are interested.
R- Thank you. I can see that you assist Mr. Lee
P- Yes. I help him with the preparation of the documents for conveyancing. I draft the contracts
of the sale of properties.
R- Can you please tell me more about your work?
P- Yes of course. As a paralegal I work as an assistant to Mr. Lee mostly. I mostly conduct all
the legal researches, and gather any relevant information that is present about the case and based
on those researches and the information I prepare a written report for Mr. Lee to use in the case. I
conduct the interviews with the clients who come for Mr. Lee’s assistance in any case.
R- That is very interesting to hear. Is that all you do?

P- No. I also handle the day-to-day office administrative tasks, like filling all the documents and
organizing all reference files of the cases. Another of my duty as a paralegal is to draft legal
documents. This is the most important part of my job description.
R- What are the documents that you draft?
P- I draft contracts of sale, lease agreements, easements, purchase and sale agreements and
power of attorneys. You said you are a real estate agent please tell me about your job.
R- As a real estate agent my job is to buy and sell property for others, this includes acting as
intermediaries between the buyers and the sellers, advising the client in regard to the conditions
of the market, price, mortgage and legal requirements, appraising the values of the property,
preparation of the contract deeds, verifying the credit information of the clients and obtaining
information relating to property.
P- That is a lot of job responsibility.
R- Yes. And I was thinking about increasing my service. I was thinking about the service of
offering the purchasers and the vendors for drafting of contracts of sales and organising the
contract exchanges.
R- That is a really good idea. But for that you would be needing the help of an expert.
P- Yes I was thinking about hiring a good solicitor who would be able to provide me with all the
legal expertise.
R- You can come to our firm if you want. As you know Mr. Lee is an expert in real estate law he
can help you with your services.

P- You are right I should consult your solicitor with this business proposal soon. I have got your
business card I will call you when I initiate the plans to book an appointment with Mr. Lee.

Client- Yes B speaking. May I know who you are?
P- Hello Mr. B, I am calling from ABC law firm. Your friend Mr. (name) must have informed
you about his consultation with us?
C- Yes he has told me that he has discussed my condition with you people.
P- Yes. And let me introduce myself to you. I am (name), working as a paralegal in the ABC
firm and I’ll be assisting you with this case currently. As you might know that ABC firm is one
of the leading firms in Australia and currently we operate in 6 states that include Queensland,
Tasmania, New South Wales, South Australia and West Australia. We have the largest pro-bono
in entire Australia and have been listed in top magazines hot list multiple times because of our
work. Our company provides various services to the clients which include finance, data security,
anti-corruption, real estates, employment and work place issues which includes work place
related injuries among many other services.
C- I am glad that my friend has referred my case to such a competent firm.
P- Thank you. Now about your problem, can you give me a detail of what exactly happened?
C- As you have already heard from my friend that we both work as manual labors at the
company. Our job is to manually lift the equipments that are used for the business of the
company. One of the equipments is particularly very heavy and needs at least two people to be

lifting it. Every time any of us lifted the equipment we would have pain in the back muscle for
hours.
P- Did you inform anyone about this problem in the equipment?
C- Yes we told the supervisor who informed the management about the issue. Yet no action was
taken by the management. After a few days I started having continuous pain in back and went to
the doctor who told me that because of carrying heavy load for so long I have developed spinal
injuries and would not be able to do any kind of manual labor for the rest of my life.
P- Was the management informed about the situation?
C- I have informed them informally, but I want to review my options before taking any legal
steps.
P- The options you have are claiming compensation under the Workers Compensation Act 1951.
You can also sue your employer for the tort of negligence.
C- Can you tell me which one would be more effective and less time consuming.
P- Claiming compensation would be the best option in this case. You’ll be getting weekly
payments in place of wages, compensation for economic loss, reimbursement or payment of
medical and like expenses. However you’ll not be able to claim for general damage for pain and
suffering, and punitive damages for employer negligence.
C- Ok. I would like to claim for compensation as I have medical bills to pay urgently.
P- Ok. If you want we can help you with the procedure.
C- I definitely need your help in this. Please tell me what else do you require?

1. Like the other professions the legal profession is also guided by various legislation,
regulations and codes of practices in relation to the professional responsibilities.
In the New South Wales region the legal profession can be seen as guided by the Legal
Profession Uniform Law (NSW). Under the provisions of the Legal Profession Uniform Law the
conducts of a solicitor is guided by the Legal Profession Uniform Law Australian Solicitors’
Conduct Rules 2015 (NSW). The conducts of a barrister is guided Legal Profession Uniform
Conduct (Barristers) Rules 2015 (NSW). Under the LPUL the following legislations are also
established: Legal Profession Uniform Regulations 2015; Legal Profession Uniform Admission
Rules 2015; Legal Profession Uniform Continuing Professional Development (Barristers) Rules
2015; Legal Profession Uniform Continuing Professional Development (Solicitors) Rules 2015;
Legal Profession Uniform General Rules 2015 and Legal Profession Uniform Legal Practice
(Solicitors) Rules 2015.
2. Any organization can also be seen as conducting its affairs in an ethical and social framework
just like any individual. In an effective organization the social and ethical frameworks can be

seen as establishing the difference between right and wrong and establishes certain standards of
ethical and social behavior in all the areas of the organizations.
3. Certain skills are observed to be crucial for any individual to be exercising in the work
environment. The interpersonal and communication skills that are required for building and
maintaining business relationship are: relationship building skills, assertiveness, emotional
intelligence & self-management, effective communicator, active listener, empathy and self-
awareness, being cognizant of the non-verbal communication, respectful towards others,
appropriate behavior and receptive feedback.
4. For securing a new business relationship effective communication channels are required.
These channels of communication are- approaching the customer face-to-face; website and social
media. A business owner is considered as the company’s representative and is required to impact
the perception of the customer for the benefit of the company. The website of a company is also
needed to be optimized for solving the problems of the customers and convincing them to buy
from the business. Using the public forum to communicate would be a great opportunity for the
business to resolve the issues.
5. The New South Wales law society can be seen as conducting multiple activities for the
relationship building opportunities. Three of these activities include: marathons, trivia nights,
Christmas parties for the members.
