1EMPLOYMENT LAWSThe purpose of this assignment is to formulate a business brief regarding the case studyof Williams Construction v. OSHRC. In this regard, it is worthwhile to mention here that thelegal issue associated with the case study is regarding the petitioning for review of the FederalOccupational Safety and Health Review Commission. It was observed that the violations of theOccupational Safety and Health occurred as a result of sudden death and collapse of an employeeat the site of construction. However, the Court in this case, denied William’s ConstructionCompany a petition for judicial review.In this case, it was observed that the rules and regulations as stipulated by theOccupational Safety and Health Review Commission proved to be beneficial in providingappropriate solution (Conklin & Burgess, 2016). In this regard, it is noteworthy to mention herethat the Occupational Safety and Health Review Commission were implemented as a result ofgovernment intervention for the purpose of ensuring safety of the employees during workinghours (Shaffer & Gilbert, 2017). It is worth mentioning that the legal issue that is related to thecase was whether there was an authority on the part of Occupational Safety and Health ReviewCommission to question the accountability of the involved Construction Company in relation tothe violation of the statutes and regulations formulated by the OSHA (Yu et al., 2017). It is worthnoting that from the very beginning the Occupational Safety and Health Act (OSH ACT) hasbeen introduced as the principal federal law for the private enterprises for the purpose of keepingthe workplace hazard free. Therefore, the new agencies formulated the Occupational Safety andHealth Administration (OSHA) – the Occupational Safety and Health Review Commission(OSHRC) for this purpose.In this regard, violations were observed in different ways. Firstly, the company forced theemployees to clean the pumps inside the existing trench without appropriate safety measures,
