INTRODUCTIONEuropean Law is the systematic law that helps member of the citizen to overcome fromconflict in their working area. The law is also divided into two such as primary or secondary inwhich primary legislation are the ground rule of EU action, while on the other side, secondarylegislation further includes some regulation and directives and decision that are derived fromprinciples as well as objectives in order to handle some treaties. Present study is deal withdifferent case scenarios and its main aim is to provide or recommended some laws or legislationwhich needs to be followed by the person. Report advise Jake and Luke whether they have any right under EU law to overcometheir problem and further it describe or advise Mary and Daniel whether they can challenge torefusal to grant a student loan to Mary and also threat to hold Daniel. QUESTION 1a) Law recommended for JakeJake initially work in NHS and also work overtime and at that time, it is the duty of theNHS owner to pay twice from its normal salary. That is why Jake is dissatisfied from theirworking. Hence, it is to be recommended that Jake should use the Employment law. Employment law: This law states that the workers needs to be satisfied under their workand it also regulates the relation between workers, employers as well as trade unions. Further italso states that the people at work in UK also benefited from all human rights and the ownershould provide minimum wages to their work. If the owner take some work from employers thenit is the duty of the company to pay extra wages to them. Similarly, in the case of Jake, NHSshould provide some extra wages because he did extra work occasionally for the company inorder to provide profit 1. As Jake is also dissatisfied with this and considering some proceedingagainst the employer as they did not provide any extra wages. But on the other side, the contractof employment states that if Jake did any extra work then he receives twice the normal pay ratein a form of overtime work. also continues to obligation under the EU law and then employment rights are also remainedunchanged. The employment law only protect those employees who have an extensive rights andif a person do the work and they have a control over the work with a mutual understanding atthat time there is nothing inconsistent with the relationship of an employment2. But on the otherside, while signing the document of a contract, the employer and employees should have tofollow all the rules and regulations such as duty of trust and the confidence is quite importantand they have to behave in a way that is also calculated to build the brand image in market.Further, in the case of Jake also, the employee should also imply the duty of loyalty and fidelitythat also prevents an employee and they have to make the information confidential regarding thesystem as well. As Jake do extra work and he wants wages in return of this, which is not wrongand it is the duty of an organization to pay for the same because the contract of an employmentshows that he receives double wage when he do extra work i.e. overtime. Under the employment law, the contracts of employment needs to be verified and eventhe court also specified the rules in order to determine some minimum charter of rights such aswhat are the basic terms and condition and this should be realized by Jake as well. The term ofthe employment are those things which are promised by an employer to employee before thework begin 3. However, it is also recommended to Jake, that the employment law will be morehelpful to him in order to overcome from the situation. Even this law is comes under theEuropean law and hence, the contract of employment is a formal written document that is signedbetween the employer and employee to clear all the things before start the work. The same thingis happened with Jake as well. As he do extra work and support NHS to earn more profit but hedid not receive same amount even though it is written in a document that he definitely get justdouble from its normal wage at the time of overtime, but this is not done. As his owner did notallow paying extra wage from his salary that force Jake to take wrong action as per the situation.That is why it is to be recommended to Jake that he can go to Supreme Court and on behalf ofEmployment law which states that the system is wrong because it is written document that helpsa system and bind both of them with each other in order to complete the task. 2Rodgers, L., 2018.
