INTRODUCTIONEuropean law is range of rules and regulations applicable over the members of Europeanunion. European union laws have a major influence over its member states legal structure, asthey need to form each law in accordance with these laws. The present study provides legaladvice and legal solution for some business disputes relating to the export of products in themember states of European union. The solutions of these problems is based on various articles ofStabilisation and Association Agreement (SAA) and some previous judgments of some identicalcases. QUESTIONSFacts related to case:Kako-Si d.o.o. is a manufacturing company which sales goods in the community ofEuropean Union. The company wants to enhance its sales in the EU due enforcement of the SAAAgreement. For this purpose, company developed several strategies and implemented them aswell. Although, now company is facing several problems. 1. Imposition of an increased custom duty of 25% by commission.Issue:The commission imposed an increased amount of custom duty of 25% on the ground thatexcessive demand of dolls of Kako-Si company is causing a serious injury to the domesticindustry and layoff of the employees of those industries as well. Rules:Stabilisation and Association Agreement (SAA) Article 17:Article 17 of SAA says that any additional custom duty imposed upon the importedgoods in Mecedonia would be abolished after imposition of stabilisation and associationagreement in the member state of European Union.Further, the article also states that if there is any quantitative restriction imposed by thecommunity and measurement, that is having an equivalent effect, it would also be abolished onthe date of implication of the SAA in the member state.In this regard, no custom duty can be imposed on the transaction of import of goodsbetween European community and the Mecedonia.
