INTRODUCTION
Health and safety is the term which is described concerning the health and safety measures
through which the acts and the policies are being framed (Freitas and et.al., 2017).
The report will analyze the legislative framework for health and safety. Along with this,
employer and employee roles and responsibilities for health and safety by legislation will be
evaluated effectively. Consequences of noncompliance with health and safety requirements will
be analyzed and complying with others to health and safety requirements will be identified.
Furthermore, importance of record keeping will be identified in relation to health and safety.
Range of risk assessments will be used in health and social care settings along with carrying of
risk assessment in proper manner. Recommendations will be made for the risk assessment and
further evaluation will be done for the effectiveness of health and safety policies, procedures and
practices in the setting.
MAIN BODY
1.1 Legislative framework for health and safety in health and social care work setting
The legislative framework for health and safety in health and social care consist of the main
purpose of 1974 Health and Safety at Work etc Act which is laid in Section 1 of the Act and this
consists of –
Protecting individuals from the risk which may arise due to the activities which are
undertaken at the work setting.
To secure the people at work from safety, welfare and health.
This legislative framework is done in three ways which helps in explaining the core purpose of
what the legislation framework consists for health and safety act. Safety and care of employers is
considered as important under duties of care which is in regard with the health and safety.
Welfare of the employers is concerned for the purpose of how the health and safety of the
employers is concerned about (Badri and et.al., 2018). Permission of regulations is made which
helps in regarding general duties through an enabling act fulfilled and followed by the legal
requirements for the health and safety purpose. Health and safety of the individuals provides the
framework for establishing Health and Social Commission (HSC) which overall regulates the
process of the legislation and the observes the responsibilities for looking to the laws of health
and safety.

This is all incorporated within the government health and safety measures which help in
incorporating the measures through which health and safety legislation rules can be take into
consideration on large scale which ensures that this factor is the basis in which the individuals
are taking concern of the health factor to be effective and efficient on large scale which produces
the variety of how things are being framed to extent that health and social care becomes the
major concern on following the rules and regulations for the sake of health and social care.
1.2 Employer and employee roles and responsibilities for health and safety by legislation
Under the law employers are responsible for the health and safety which inculcates the
process of how to take care of the health and safety of the employees on large scale. Employers’
duties are processed in the form of how and in what ways the employer is taking the health and
safety concerns on large levels. Section 2 (1) of the Act ensures the duty of the employer which
ensures the welfare and the employees health and safety at work. This act also regards whether
the employers are providing the employees proper health and safety benefits which are in
requirement of them. The other Section 2 (2) regards in the general role and responsibility which
the employer delivers –
Arrangements are to be done which ensures that the employees’ safety is taken care of.
Minimal or least risk is there to the employees while handling or transporting the
substances at the work (Greidanus and et.al., 2018).
Provision of supervision to be done and performed for the health and safety factors.
Under the law and Section 7 and Section 8, employees are responsible for the activities which
are being undertaken by them on the scale that it provides the basis through which health and
safety factors are to be considered important and this helps in ensuring what and how the process
in following the health and safety measures under the social care act are to be considered so that
the employees are able to deliver their best while taking concerns of their roles and
responsibilities which are being undertaken on large scale.
To cooperate with the employer is the major responsibility which the employee is
concerned of to deliver.
To take care of them on the note to not give and create any problems which is concerned
with health and safety.
