The research aims to examine the question of whether Australian Aboriginals should prove a systematic common law Aboriginal title under Australia's common law as different from indigenous customary law title under Aboriginal law. The study explores the impact of climate change on Indigenous Aboriginal populations and their natural and cultural landscapes, particularly in coastal regions where rising sea levels threaten thousands of habitats and archaeological sites. Additionally, it examines the history of Aboriginal Land Rights in Australia, the current state of mining industry activities on protected land for Aboriginals, and the effectiveness of legislative policies in protecting Aboriginal land rights. The study employs a positivist doctrinal approach, utilizing secondary data, content analysis, and case studies to analyze the environmental threats and challenges faced by Indigenous communities.
