INTRODUCTION
Criminal Law is a piece of law which deals in crime. The body of law is established by
statute that is the law enacted by the legislature. The violation of law led to the punishment and
rehabilitation against the accused. This body of law is distinct from civil law. The Crimes Act,
1900 is a South Wales Statute which deals with the criminal offences in New South Wales in
Australia1. It is generally used for the acts which codify all of the criminal law. The report
examines the potential liability in the given scenarios along with their defences against criminal
liability.
MAIN BODY
Case Scenario 1: Alex for the injury of Jim
In this case scenario Jim with his mates in bar boasting about how he spent the summer by
doing work out daily in his new home gym and intake protein. In his flow of conversation he
dared his friend Alex to punch him as hard he could in the stomach. In response to it Alex rolled
his eyes to which Jim taunted him by saying ‘are you scared?’ and further provoked Alex to
punch him. After hearing Alex Punched Jim hard in his stomach and Jim feel down in agony. He
was taken to the hospital where he was diagnosed with a ruptured spleen caused by the punch.
Criminal offence is referred as crime committed against the state. The term generally used is
the “Breaking of Law”. The new south wales state government recently updated the policy in
response to the increase problem of alcohol related offences and about one punch killing,=. The
government recently enacted the Crime & other legislation amendment (Assault & Intoxication)
act 2014 (NSW)2. The act defined the terms-
Assault causing death.
Assault causing death in case of intoxication.
One state punch law are embodied under section 25A & 25B of the Crime Act, 1900 (NSW).
The act was passed by government on seeing the increase response of alcohol-fuelled assaults
causing to death. According to the section 25B of the Crime Act 1900, assault causing death
