INTRODUCTION
Law and ethical practice in health and social care is consider as an most important factor
which impact on their day-to-day practice in ethical and legal way (Ventola, 2014). It is
important for practitioner to effectively recognise and engage in the ethical and legal code of
conduct in order to perform their functions within proper framework of principles. Report also
covers national and international human right law and different policy of health care.
P1 Manner in which legislature, executive and the judiciary set legal and policy landscape for
health and social care practitioners
State government and other different related bodies hold responsibility to perform
functions that are related to legislative and executive. All these functions are of independent in
nature within parliament and execution of these laws and policies are formally ensured by
executive office. Health is a human right that creates a legal obligation to ensure affordable and
acceptable health care for all along with timely access to medical care. It is essential of every
health care unites to treat every individual in an ethical and legal manner without any
discrimination. In this report discussions has been made on, key feature of legislature, code of
conduct along with relationship in between legislation and national policy. Making and
designing legal and policies for social and health care, is very much responsible work for
different bodies, which use to come together are performing these operations. Therefore, bodies
which took part in this process are those which are very much reputed and also are able to make
policies which are beneficial for society. Roles of different bodies which use to play important
role in development of legal and policies for health and social care are as follow :-
Legislature : In this section, the bodies which took part in this are, assemblies and
parliament of nation. As it is very much important for a nation before making any law to pass it
from their parliament, so that it can get clear that different political entities get knowledge about
it and they think that yes it is beneficial for society. After this, thepolicy went to health and social
care trust of the nation, so that they can read and gather required information about it. After
making it sure that it is good for society, they use to pass it and allow nation to follow that rule.
Judiciary : After get pass from parliament and assemblies of nations along with health
and social care trust, policy go under higher court of the nation, so that they also can make study

of it and list it in constitution of the nation as an article. After this, policy become legal law for
nation, which society and different health and social care have to follow.
In addition to this it is also important for health care practitioner to treat every individual on
equal basis and provide them affordable treatment. Along with this it is important for health care
units to abide all necessary legislation such as risk base emergency management programme and
equality in treatment as to conduct their services in best effective manner. Along with this
practitioners by abiding all these health related law can become, innovative, thoughful and
skilled. These law protect right of public and safe guard their interest. All these law will help
hospital to expand their growth by increasing their efficiency of health care system. Ethics would
encourage practitioners and healthcare professionals in reporting any sort of inconsistency in
practices within healthcare centres. Moreover, ethics would also enable them in following the
code of conduct as well as effectively practice keeping in concern accomplishment of all the
requirements. In my experience, ethical guidelines like accountability yo patients, providing
accessibility and other guidelines reflect the role of ethics in consistent following.
Healthcare professionals must know the importance of achieving a balance between the
well-being of an individual and the person who is taking care of the patient. There should not be
restriction on rights and freedom of any individual which is involved in exercising of functions.
The standards cannot be achieved simply by crisis management, it should include a
determination on preventing care and support needs and supporting people to live independently.
There are several tasks, which could support practices in meeting these standards. For instance,
while provision of healthcare, certain information is required to be acquired in relation to provide
care. A task which could ensure meeting national standard is establishing an effective safety
system which could keep their information confidential. Another example is providing effective
accessibility of services to patients regardless their race, gender, etc. These tasks would help in
ethical practices in meeting of national professional standards.
P2 Summarise key features of legislation, statutory guidance, codes of practice, and national and
organisational policy.
There are ample number of bodies which took place in designing of legal and policies of
health and social care (Martine, 2015). Along with this, there are different features of these
bodies, which help them in making special and also make them different and unique from one

another. Beneath are some key features of these bodies which took place in legal and policy
designing for health and social care:-
Legislature :
In this, bodies which took place are parliament and assemblies of the nation, as the key
feature of this are, people which are part of these are big name and fame of the nation. These are
those which have played an important role in development of nation. Along with this, their
another feature is they use to make laws, and also use to make enquiry over government of
nation. This law creates a legal obligations on every care institutes according to which they are
legally obligated to ensure access of timely and affordable health care services to every
individual.
Judiciary :
Judiciary is one of the most important body of a nation, as they use to make hearing over
different legal issues, so that they can provide proper solution for it. Along with this, they use to
finalise new rules and regulations, after finding that they are helpful and good for society of not.
There is no set approach that is considered in each case on merits. The principle of adding
standards to the healthcare department must be embedded by local authority care and support
system. These should consider relevant aspects of raising standards of facilities and services of
healthcare. In the care and support planning, needs are considered for enhancing the facilities and
needs of an individual. In addition to this, state right law in relation to health states that it is
important for health care units to give proper access to each and every individual without
discriminating them on the basis of race, age and any other status. This law helps in performing
health related services in best effective manner.
These standards are relevant to all aspects of service design and commissioning. This is
done in order to achieve improved outcomes. This is done for strengthening and innovating to
achieve improved outcomes for adults using social care, their carers, families and communities.
M1. Role of Ethics in informing health, care and support service practice
Ethics, in healthcare refer to specific codes of conduct as well as effective practices
supporting values and beliefs of a certain healthcare organisation. As reflected in the case study,
where care standards were unmet in Mid-Staffordshire NHS Trust found, resulting in death,
ethics could help in informing health, care as well as support service practice. Hospital by
facilitating their services within proper code of conduct can get the desired outcomes and help

their employees to understand their actual roles and responsibilities. The standards of healthcare
facilities should be applied and they must have eligible needs. The authorities must consider the
needs of person and providing effective interventions at right time for escalating and helping
people to maintain the independence for longer time.
D1 Evaluate own national system of government in relation to its effect on health, care and
support service practice and practitioners
Government of a nation provides an adequate support to an organisation giving health, care and
support services through providing them funds, giving relaxation in the tax payments etc. It
encourages them to facilitate customers through providing health care services at an affordable
prices. In relation to this, it is important for a hospital to provide all possible health care
facilities to their patients without any discrimination on the basis of their caste, greed and colour.
P3 Describe the relationship between key legislation and national policy of direct relevance to
health and social care practise
Safeguarding- (roles and responsibilities in health and care services) This provides
guidance to clarify about the roles and responsibilities of the key agencies that are involved in
adult safeguarding. The major objective is to ensure that right things are done by right people at
right time and working within their own agency and with partners.
Information Sharing Guidance (Department of Health)- According to this guidance, a good
practise of information technology is offered on when and how information is shared
professionally and legally. This guidance is useful for supporting preventative work and early
intervention where decisions are not clear about the information sharing.
Information Sharing Guidance for Practitioners and Managers
Commissioning for better outcomes is a guidance that outlines standards for supporting a
dynamic process of continuous improvement. This is done through peer review and self
assessment to challenge commissioners and the partners (Nelson and Staggers, 2016).
Care Act Statutory Guidance- The legal framework for the care Act is supported by the statutory
guidance. It is the legal duty to have regard towards it while working with adults who needs care
and support. This is associated with well-being, promoting well being and well being throughout
the Care Act.
