INTRODUCTION
English Legal System is based on two different legal systems i.e., Criminal Law and Civil
Law where each of the branch have their own courts to deal any of the cases which arises in front
of them. In criminal law, court only discusses those cases which non bail-able in nature and for
protecting the right and interest of common people, criminals are kept within the jail till the date
of judgement given by judges. In case of civil case, the person who is found guilty are being
punished but person have the option to get bail as it one of the bail-able offence. In context of the
file, various topics will be explained that how any of the criminal cases are entertained within
court. Also, process of jury will be explained that how any of jury is selected for taking any of
the particular decision.
PART A
Brief outline of the facts of the criminal case that has been observed. It must include Defendant,
the charges and the stage of the trial which has been observed.
Criminal cases are the cases which are entertained within three different courts and they
are magistrates court, Crown court, Youth Court. In magistrate court, there are two to three
judges but there is no requirement of any jury in magistrate court. One of the famous case is of
“The murder of Ben Kinsella” where a gang of black teenagers in Islington, London. It was one
of the case where whole of the media was focusing on the case. There were three different
defendants in the case and they are Alleyne, Kika and Chandwell Heath. All of the three
defendants were given the punishment of life time prison (Ritchey and Vanek, Thomson Reuters
Global Resources ULC, 2018).
The main thing which is needed to be understood that the case which has been imposed
on all of the three defendants is murder case. The jury in this case observed that it is one of the
illegal activity which has been performed by them and if there was any of the issues which they
were facing from the side of Ben then they must have informed the police (Reimann and
Zimmermann, 2019). The main reason to give the lifetime prison to every criminals is to
improve their activities for better future and provide the justice to the one who is innocent.
The Role of Crown Court in this particular case is that firstly they must pass the order to arrest
the criminals due to which problem have raised. Then, it is required to understand that what were
the main reason to committee the crime. Then, lawyer is required from both the side i.e.,
