Awards are minimum employment standards based on occupation which are
applicable as per the National Employment Standards (NES) while an enterprise
agreement sets out certain conditions regarding employment for the employees
at their workplaces (Stickle 2016). A common law employment contract is made
when an employee is hired and it is made under any circumstances.
Common law employment contracts serve as the source of various terms and
conditions that have been added to the framework of the minimum entitlements
that are provided for under the legislation or in the statutory
agreements. Moreover, it is found that the pay rate within the enterprise
agreement cannot be reduced in comparison to the pay rate of the modern
award.
Question 2
Referencing the documents that govern employment conditions within your
organisation, outline 3 employment conditions and the legislation and/or policies
that apply to them.
Some of the documents that govern the prevalent employment conditions are as
follows:
1) Employment agreements- This is common for all the employees irrespective of
which organization they are working in and this deals in some specific terms and
conditions the employees have with their employer. This contract depends on
the workplace agreement.
2) Workplace Agreement- This kind of an agreement is a statement that deals in
reciprocal rights and associated responsibilities that has been discussed between
the employees and the employer. Workplace agreement permits the employers
to set the employment conditions that are applicable for the business.
3) Award- Some of the companies set out their employment conditions in form of
award where award acts as a legal instrument that is created by an industrial
tribunal.

a. Unlawful dismissal
Unlawful termination is given in the
Fair Work Act 2009 in which it is
stated that unlawful dismissal occurs when an employee gets fired from
the organization on discrimination basis (Stewart 2016). In an organization
dismissal must be done based on the performance and disciplinary issues
and this should not be based on discriminations. It is found that law based
governing dismissal generally varies as per the terms of the employment-
based contract and that is under the laws as well as public based policies
of the jurisdiction. For example, if complaint against bullying is done then
the workers feel unsafe and as a result the employees can make a
complaint.
b. Equal Employment Opportunity
Workplace relations get affected if equal employment opportunity is not
provided. Equal employment opportunity refers to the fact that employees
should not be discriminated on the basis of their age, sex, colour, religion,
national origin and many more such parameters. The overall policy-based
objective is mainly for the employment of various types of discrimination
related laws that is mainly examined in order to summed up the phrase of
equal opportunity. It is found that these types of laws do not generally
aims to develop proper outcomes but it also helps in making sure that all
the employees as well as job applicant have equal opportunity for properly

d. Work Health and Safety and risk management

must be proper legislations to look into the same. The business should
have risk management plan in hand in order to avoid risks and in case of
any there should be a plan to overcome the same. The work, health and
safety-based risks are generally identified by using methods including
identification of hazards, assessing risks, controlling risks as well as by
reviewing various types control measures.

confidentiality
The National Employment Standards are responsible to set certain
minimum standards of employment relating to the weekly working hours,

Performance management is an annual performance review. It refers to a yearly

use performance management system are:
1) Performance management system is mainly used in order to align the goals
as well as objectives of the organization.

organization must work on the same targets as well as goals if they generally do
not have proper vision, conflict as well as competition.
3) Valuing employees: The teams become successful when they generally draw

organization. It makes work easy as what to work upon first can be realized
just by checking the priority list.

A positive learning environment can be created through the management
of workplace relationships.
Workplace relationships can be managed in order to create a positive
learning environment. For example if a junior excels in some specific
sphere then the senior should not be hesitant to take his suggestions in
order to do task related to that sphere.
Group dynamics can both support and hinder team performance.
Group dynamics refer to how team member’s distinct behaviours impact
the other group members and this can have both positive and negative
impact as this depends on the compatibility factor and low level of
compatibility hinders the performance of the team while high level enables
it to perform well (Forsyth 2018).

The skills of a team leader can assist in preventing issues from arising.
Team leader heads the team and thus he is the person responsible to give
assistance in preventing the issues within the team. The whole team his
under his guidance and thus he keeps the capability to assist in case of
issues going on in his team that are affecting the performance of the
team.
Brainstorming can be used as a strategy for issue resolution
Brainstorming can certainly be used as a strategy in order to issue
resolution as it is a technique that generates ideas to solve a design
problem (Rawlison 2017).

What is your personal approach to effective Time Management? Provide three
examples, including at least one use of technology.
Three examples of effective Time management are as follows:
1) Delegation- It is helpful in managing time and thus breaking down work into
simpler steps help adjusting time and completing the task in time.
2) Prioritizing work- A priority list helps to save time and utilize it properly as at a
glance it can be ascertained which task is of utmost importance and needs to be
addressed first (Kirillov et al 2015).
3) Keeping a log- In order to keep a track of the work I have done throughout the
day a log can be maintained and with the prevalent technologies any one can be
used like mobile phone notes and individual tracker application updated in the
personal computers.

kept in a priority list so that it gets completed on time and proper work-life
balance is maintained.

The improvements in the workplace are a necessity for any organization, the
organized systems and processes play a vital role thus in order to keep a track of
these regular sessions should be organized and the system updated. In case of
record keeping the technological advancements have been used such as online
databases that are easy to work with. The higher officials take care of learning
in the workplace and reviewing whether the work environment is aligned to
learning or is it getting derailed from the track. For example, an engineering
team which is continuously finding a number of ways in order to properly
improving a figure merit including the energy conversion rate of the solar panels.
