P1 Comparison of different legislatives and statutory requirements for monitoring ad improving
quality of practice in health and social care
Legislations: There are several legislations and regulations that are associated and implemented
by CQC such as:
Regulation 12: Under health and social care act 2008, this regulation is being developed with the
main aim of providing safe care and treatment to people in home care services. This regulation
can help this commission to prevent people from avoidable harm. Under this regulation, it is
important for healthcare providers to make sure that whatever equipment’s and tools they are
using for treatment are safe (Regulation 12: Safe Care and Treatment, 2020).
Regulation 11: It is regulation under health and social care act that represents and developed for
need for consent. As per this regulation, service providers need to take written consent from
service users in order to protect against law suit and improving quality of care. Consent of
service users is vital while providing care as it can help in decision making process and make all
functions of service providers ethical (Regulation 12: Need for Consent, 2020)
Regulation 9: As per this regulation, service providers need to make sure that treatment and
approaches that they are providing to service users are personalised and specifically for them. It
is also important for service providers to focus on person centre care approach in order to
improve their health and providing treatment as per the type of disease and requirements
(Regulation 9: Person Centred Care, 2020).
Data protection act 1998: It is an effective act that was being developed or designed for
protecting personal data of people. In healthcare sector, it is important for service providers to
maintain confidentiality and making sure to service users that their personal information are
being kept safe and secure with them. As per this act or legislation, CQC can improve its quality

and can make service users believe in their service by complying all rules and protecting service
users’ information.
Health and safety act 1973: This act consists of wide ranging duties on service
providers. As per this act, it is important for employers or services providers to protect health,
safety and welfare at workplace for all service users. Service providers need to make use of all
safety tools for protecting themselves and service users from injuries, accidents and any other
problems in healthcare (Navarro, 2017). Patients or service users’ safety is must for improving
their health and providing better or qualitative services to them.
Healthcare approaches
Self care and self management
Self care and self management are two approaches and strategies which are totally
changing the relationship among citizens and service providers as well. Self care first to all the
actions which is being taken by individuals who do not have any kind of disease but taking
precautions so that they do not get any kind of disease. On the other hand self management is it
tool which used by those people who are already suffering from any kind of disease.
Person centre care approach: It is an effective healthcare approach in which health care
providers focus on patients’ specific needs rather than common functions. When healthcare
providers make use of this approach, then it makes service users’ feel valued and they are more
likely to engage in treatment process. It improves overall quality and relation between service
users and providers.
Societal change: It is another effective approach which aims to change society as a
whole rather changing individual behaviour. The main reason of making use of this approach by
CQC is to make changes in physical, economic and social environment towards healthcare
services (Shore, Cleveland and Sanchez, 2018). Making society members able to support people
surrounding them is another effectiveness of this approach.
Educational approach: This approach of health promotion believes that by increasing
knowledge of people about their health can improve quality of care. This approach can increase
service users’ engagement and fast recovery by CQC.
