This article analyzes a case study of Aldi Supermarkets to discuss the negligence and duty of care in commercial law. It covers the elements of duty of care, breach of duty, causation, damages, contributory negligence, and voluntary assumption of risk. The article concludes that Aldi Supermarkets owed a duty of care towards the customer, breached the duty, and caused injury due to negligence. The damages suffered by the customer were not too remote, and the company cannot rely on the defence of voluntary assumption of risk. However, the company can rely on the defence of contributory negligence.
