This is a sample Notice to Leave (Form 12) for Residential Tenancies and Rooming Accommodation Act 2008. The notice is issued by the lessor or agent to the tenant/s when they want them to vacate the property by a certain date. The notice includes information about tenants’ rights and obligations. The minimum notice period for without ground is 2 months for a periodic agreement and a fixed-term agreement. The tenant/s must vacate the property by midnight on the specified date. A tenant must be given at least 2 months notice, unless they have breached the agreement.
However, the tenancy only ends on the end date of the agreement or the end date of the notice
period (whichever is later). Both parties can agree to end a fixed term agreement early but it
must be agreed in writing.
