For providing better treatment to offenders with mental health, there is a requirement for
mental health professionals to adopt some strategies regarding this. More Americans with mental
health concern are becoming incarcerated. In the context of UK, it is reported that mental illness
is rising and most of them are behind the bars which needed to be cured. There are around
31,000 people with mental health issues are offenders. Negligence of treatment to them is the
major concern of human rights. In England and Wales, there are several problems solving courts
that are related to drug courts but not in mental health (http://theconversation.com/why-the-uk-
needs-a-separate-justice-system-for-people-with-mental-illness-98364).
Criminal with metal health condition should not be punished because they are not in the
condition where they can understand the difference between right and wrong things. Hence it is
essential for the authorities to understand their health situation and treat them well so that their
mental health condition can be improved (Bush, Harris and Parker, 2016). Mental patients in
prisons have to face maltreatment and also they suffer from stigmatization which impacts on
their health condition. Hence it is the ethical obligation that such kind of persons should be
treated well so that they can understand difference between right and wrong activities. UN
resolution 1991 states that if patients with mental illness commit any kind of crime then and if
they are needed punishment for the same then they must get proper medical facilities and
doctors and other jail staff are required to take care of their dignity. Incarcerating mental patients
have no control over their anger hence they can create violation hence it is essential for them to
get punishment for their crime but it is also necessary that they get care in the jail and no
maltreatment happen with them.
Criminal justice system has to emphases more on deterrence rather than their treatment.
In this if a person with mental illness commit any kind of crime then they are sent to jail but
they get general psychiatric facilities there during criminal proceedings (Birks and Buyx, 2018).
If the person has made minor crime then they can be diverted towards mental health services
before getting any punishment for the same . This thing helps in minimizing future crimes.
Offenders who are suffering from problem of mental health can be given special care rather than
punishing them. The government and authorities instead of punishing them can send them to any
rehab centres where they can be provided with proper care and treatment. This can assist
offenders in enhancing their health outcomes Psychotherapy is the treatment of mental illness
