INTRODUCTIONTravel and tourism is one of the most interesting activity to be carried out by people ofevery corner, it has been seen that people love to travel a lot and it is an activity which shall be inthe favourite list of everybody. In order to make or promote travel and tourism, the department ofTT had made several changes in ticketing and providing accommodation. (Sârbu, Dimitrescu,Lacroix, 2015.)This has done to attract various tourists. In the same manner government has alsoinitiated many ideas in order to protect the interest of any traveller and to protect the activity oftravel and tourism. The following project will showcase what is the importance of putting legalregulatory framework in travel and tourism and how it shall help in protecting the rights of thetourists. The following project will showcase the framework of legal regulation in context totravel and tourism.Task 11.1Tour and travel is the something which fascinate almost every person and people go forholidays alone or with their friends and family, they search for the best offering travel and touragencies and they also consider for the best facilities they offering. It is the responsibility of thetravel agencies to take care of each and everything of the their client who deals with them andproceeding for its travel on believing the concerned travel agency so there are some laws has alsobeen framed by the tour and travel regulatory authorities to protect the rights of the travellers, incase of any violations of the rights of the people the legal TT rules and regulations helps toprotect the rights.(Healy, Kamya, 2014). TT sector has a worldwide scope business andsomewhere complicated also due to having variety of package offers to various people in thecountry or outside the country, to the people of different culture and this makes this somehowcomplex . If any person wants to start the travel agency business or wants to sell flights then theymust comply with some stipulated rules and regulation set by the authority like the CivilAviation Authorities (CAA) Air Traffic Organisation Licence (ATOL) Regulations of thecountry. Where one person deals with any travel and tour agency then being contract this fallsunder the common law and the tour and travel agency is the offer party and the person going ontravel is the another party, and so in case of breach of any terms and conditions the aggrievedparty can file the suit as per the laws and the defaulter shall be liable to pay the financial refund
if any taken by him, doctrine of negligence shall also be applicable on the travel agency if itneglect the duty of it or by any employee of the agency then also the doctrine of negligence shallbe applicable since the another party is trusting the agency and so there the duty of care arises onthe travel agency, it will be responsible for all terms and conditions agency promised to theparty.(Kjervik, Newman 2016). And so the there is legal and regulatory framework for protectingthe rights of the people and also to regulate this TT sector finely and complying with theseavoids the huge issues and sort the things rapidly and easily. In the case of Mr. and Mrs. Jones, they wants to book their summer holidays and so they haveobtained a brochure, they find on the website of tour operator suitable package for them inPortugal. There are some statements they find that in the total mentioned amount they willprovide the flights and hotel accommodation and they will also be picked up at the airport bycoach and taken to their hotel so here in case if breach of any terms or any failure on the accountof travel operator the legal and regulatory framework governing TT industry will be helpful forMr. and Mrs. Jones and it will protect the rights of them they can claim their rights.In the case of Betty and Steve their experience wasn't good they found no quality in the servicesof the travel agency and not even the good accommodation so as per the legal framework of TTthey having right to sue the travel operator and to get refund of their monetary loss they bear tobook another hotel and the local taxi fair also.(Pennings, 2016).So the legal rules and regulations in TT sector is important to regulate this sector smoothly. 1.2Transport means transporting the tourist from their generating area to his destination.Transport acknowledged as most important factor which is contributing in the tourism sector.Transport is the essential part of the tourism which makes it complete and better. Where anyperson forethought any travelling packages then he shall consider the transport facility also in thepackage, without transportation the travel is incomplete. Without transport the travel can not becompleted and if travel will not happen in the country then economy of the country will notgenerate and so indirectly the transport helps in the economy of country, transport providesemployment to the local people also so the transportation plays major role in the travel andtourism sector.(Suciu, Obrad, Gherheş, 2013). Transporting agencies provide the transportationfacility to their clients and there the duty of care also arises on the transport service provider,they are the provider of the transport service and so they need to be careful in serving the facility
