INTRODUCTIONProperty law in Australia is a system of laws and regulations which defines the rights,interest and responsibilities of people in relation to things and property. These laws outline therules related with right to possession and ownership of object and property. The matters relatedwith property in New South Wales of Australia is governed by the Real property act, 1990(Courtney, 2017). In the present report provision of this act are applied to the given case of Malover the property purchased by him and his 3 sons under joint tenancy. Mal is presented withdifferent rights under joint and common tenancy and then a legal advise is presented to him overthe rights and possession related with Oakland property. MAIN BODYISSUE:Mal along with his three sons, Tom, Dick and Harry purchased Oaklands in rural NSW.The property was purchased under an auction for $600000 where Mal paid $300000 and all hissons each paid $100000. The original contract stated Mal as sole purchaser. Subsequently, 3weeks later a conveyance deed was carried out stating all 4 tenant in equal share. The term oftenancy is common in contract is crossed out and with a black pen it is written as joint tenant. Ithas been advised to all 4 (Mal and his three sons) that all of them have separate legal share inproperty under common tenancy and a general agreement over non involvement of outsider inOakland (the property). Harry died unexpectedly and he left his share to charity which wasmentioned in his will.
