Q3. Explain briefly the importance of trademarks and various IP laws. Give any two
Australian trademarks for goods and services used for advertisement of products
It may be arguably stated that trademark is one of the most essential parts for any business in
recent times (Stim, 2017). It has become synonymous with businesses in recent times. It has
been proven in varied studies that the purchasing decisions of any set of customers are heavily
influenced by the trademarks and the reputation that the brand holds. Often, trademark is a
common factor which is effective for the customers to recognize a certain brand (Ginsburg,
2017).
Therefore, it is often suggested that the tactical utilization of trademark can be effective as a
communication tool (Dratler and McJohn, 2018). The emotional as well as intellectual attributes
invested by the creative to set apart a specific brand or product from rest of the competitors may
be well reflected through the help of a proper trademark. One of the most important aspects is
that a standard and well-designed trademark can be effective in connecting with wider sets of
individuals (May, 2015). Without even having to use any language, communicating and getting
connected to the target audience can be easy. One of the finest examples can be of Nike’s
‘swoosh’.
Since the competition in the market is rising at an alarming rate, it is important for any
organisation to ensure that they are able to establish their different identity (Correa and Yusuf,
2016). Hence, trademark is regarded as an important tool which can provide that different
identity to the company. Thus, in order to attain relevance and attract the varied sets of
customers in most effective manner, it may be stated that the utilization of trademarks can be
most suitable (Course et al., 2017).
It may be stated that the trademark falls under the vast category of intellectual property. This
also includes factors like patent and copyright (Downes, 2016). It is important that in order to
protect and retain the uniqueness of the company, so that the brand recognition among the set
customer segmentation is enhanced. Therefore, adhering to certain protocols and standards
may be regarded as suitable option that can be considered (Mendis et al., 2019). There are
varied sets of intellectual property laws which are needed to be followed by organisations.
These laws are prevalent with the intention to safeguard unique identification of any specific

company (Dratler Jr and McJohn, 2018). In simple term it may be stated that the Intellectual
Property Law deals with regulations concerning legal rights to invention designs as well as
artistic works. Hence, it may be inferred that the law is responsible for protecting the ownership
(Bracha, 2018). The purpose of these laws is to provide control over the intangible resources. It
provides incentives to the people who engage in development of creative works which may
have potential to benefit the society (Hughes, 2018). The fear of misappropriation is adequately
tackled by creative minds with the help of proper IP laws. The IP laws grant inventors and
authors the authority to hold the exclusive rights of any property. It is also responsible for
regulating the foreign and interstate commerce (Meurer and Depoorter, 2018). In wide sense,
there are different sets of Intellectual Property Laws:
Trademark laws are responsible for protecting symbols, slogans, names, which are generally
utilised for identification of services or products. The major purposes of these laws are to avoid
confusions and reduce chances of being misled in forms of advertising (Rosenblatt, 2018). The
consumers are able to distinguish one brand from another with the help of proper trademarks.
However, since the goal is to establish distinction, generic or descriptive marks may not be
considered suitably qualified (Vaver, 2018). These rights may potentially last for a lifetime.
However, registrations are needed to be done accordingly.
Patent provides the inventors the right to use their products in the market place or they may
consider transferring the right to someone else to attain profits. This may include items like new
machines, improvement in existing technology, and manufacturing of the products and so on.
Similarly, copyright is applicable in case of music, writing, pictures or other original artistic
expression. Copyrights are generally valid throughout the lifetime of the owner, plus 70 years.
Hungry Jack’s is one of the most famous trademarks persisting in Australian market.
In addition to this, Tim Tam can be regarded as another famous trademark.
