INTRODUCTION
Children in criminal justice cases have historically been handled similarly to that of adults.
They were also subjected to the justice system that deals with criminals to that of adults. At the
starting of the twentieth century, the Australian children had the same punishments which were
imposed upon adult offenders, for any offence which was committed by them like: corporal,
labour, capital punishment, etc. Children who were not above the age of 6 years were too
imprisoned in the jails or prison of Australia until the mid of the nineteenth century, when there
existed no distinct category for the "juvenile offender" in legal systems (Davidson and
Petherick, 2020). However, it is now generally accepted in Australia and around the world that
juveniles should be subjected to a different criminal justice system from adults, the one that
would also recognize and distinguish between their inexperience and immaturity. After the UN
regulations upon juvenile offenders, minors are dealt separately from that of the adults and are
also handled leniently comparing to the adult offenders. The aim of this essay is to examine how
judicial systems and legal processes can be used to solve social problems in Juvenile
delinquency.
MAIN BODY
The juvenile justice system consists of a series of procedures and methods for dealing with
children and adolescents who have committed, or are suspected of having committed, a crime. It
mainly deals with children ages 10–17 at the time of the crime in Australia, but there are some
differences between jurisdictions. The monitoring of young people in the community or in jail is
an important part of the system.
In Australia, the juvenile justice system prioritizes the health and wellbeing of young people
over punishment (Baker and Istvandity, 2017). It's about admitting that they're imperfect and that
they will make mistakes, but it's also about offering them a chance to move away from any
behavior that is harming them or others. Each Australian state's juvenile justice system is unique,
but there are some similarities. One of them is that children under the age of ten cannot be held
criminally liable.
The police would be the first point of contact for adolescents and teenagers in the juvenile
justice system. If a child is detained, the police will question him or her. A parent or guardian
must accompany them if they are under the age of 14. If they're between the ages of 14 and 17,
