Parrish, Richard. "Case C-36/74 Walrave and Koch [1974] ECR 1405." In Leading Cases
in Sports Law, pp. 45-64. TMC Asser Press, The Hague, The Netherlands, 2013.
This article discusses the judgment in the case Walrave and Koch [1974] ECR 1405 and the
implications of the judgment on the interpretation of sports law in the European Union. Sports
law attributes that specifically pertain to commercial transactions are growing with the age of
merchandising and commercialism. The EU sports law framework was said to have been
breached by the enactment of a particular legislation, this was the crux of the contentions of the
claimant. The article analyses a judgment which is a secondary source of law but is binding
within the jurisdiction it applies to and would have a persuasive effect on the interpretation of
sports law in the event of any dispute.
Mitten, M. J., Davis, T., Smith, R. K., & Shropshire, K. L. (2016). Sports law and
regulation: Cases, materials, and problems. Wolters Kluwer Law & Business.
The book provides a comprehensive approach to interpretation of sport law in Australia through
judicial precedents and their resulting implications. It can be inferred that a majority of sports
law regulations can be held to have more commercial applications which aid in the overall
functioning of the sphere of athleticism. The book analyzes statutes which are a primary source
of law and case laws which are secondary sources of law. Thus it consolidates the various
spheres of legislative intent and interpretation and further uses judicial interpretations to explain
the underlying rationale in all cases.
