Fitness for duty: compliance
Note: You’ll need to refer to your position description and the Australian General Freight Co. CoR policy document to
complete these tasks.
Scenario:
It’s a busy Thursday afternoon when you get a call from the receiving manager asking you to come to the office. A
delivery has just arrived and the unloading staff have advised him that the driver appears disoriented. The receiving
manager spoke to the driver and says he is clearly unwell, and wants your opinion as to the state the driver is in.
The load was delivered on time and unloading commenced as per the receiving schedule.
The receiving manager had the safety officer called to escort the driver across the site to the sick bay.
The driver is evasive when you question him about his schedule prior to this delivery, i.e. over the last 24 hours.
The driver tells you he wants to leave as soon as the truck is unloaded, because he has a back load to pick up. Unloading
is expected to be completed in a half an hour.
You check the driver’s paperwork. The delivery schedule is correct but you know by the state of the driver and his
evasiveness, that something is not right. You know the driver is badly fatigued, and you believe he is probably not fit to
drive.

certainly allow to attain obtain effective result that whether permission to drive should be given or not.
4. As part of your supervisory responsibility, you inspect the driver’s work diary (on the next page). For the purpose
of the simulation, imagine he has written in Thursday’s date in the date field.
What do you think of this diary entry? In your answer, explain what you are going to do after seeing this.
The diary entry will be the most important in this respective case because it is the only way through
which entity can accomplish their goals and target. It is necessary to understand that the diary entry will allow to

Fitness for duty: breach
Scenario
While you’re speaking with the driver, the unloading and backloading are completed. Despite your best efforts, the
driver gets back in the truck and drives off. You know as soon as they start pulling away that this is going to be serious.
After all, they’ve left without paperwork: that’s classed as theft! In the distance at the other end of the yard, you see
them yelling at the security officer at the gate, and waving something at them. It looks like your security officer is pretty
scared. They raise the gate and let the driver go.

Shortly after the driver leaves your premises, the receiving manager of the customer (under instructions) calls the driver
directly and offers him an incentive of $1,000 cash in hand if he can get the load to them according to the original
schedule.
The driver falls asleep in the early hours of the morning coming down a steep grade. The truck fails to take the bend at
the bottom of the hill, crosses the freeway and seriously injures three passengers in a vehicle travelling in the opposite
direction. Authorised officers arrive at your premises to investigate the background behind the incident.
1. Other than speaking to you, the despatch manager, and other witnesses, what might the investigating officers
legally do and or take from the premises? Briefly describe the evidence you think they might need.
There are number of documents which are required by authorised officer while investigating any of the
information. It is necessary to check different documents because it will certainly help to find some of the clue in
the case which is necessary to resolve the problem. Firstly, authorised officers can ask about licence which is
among the most important documents. Then daily entry sheet can be also become the crucial documents. Some

case.

Classes of theft There are number of legal compliances which must be fulfilled by any of
the driver while driving the vehicle. It was found that driver took the
vehicle loaded with deliverable products without obtaining the permission
of authorised officer. It is necessary to understand that it is one of the
offence where driver can fall under huge problem. Under this types of
situation, if any of the issue arises then ultimate liability arises upon driver
himself.

of the information is being asked with them. Looking at the condition of
driver it was being found that he was not in the condition where he drive
the vehicle. It is necessary because it will allow to identify whether person
is able to take driver vehicle or not in appropriate manner.
Presence of carelessness
for personal benefits.
As soon as driver left the deliverable spot, it was found offer was given by
the manager to driver that $1000 will be rewarded as cash if product will
be delivered on time. This was the main reason that driver even took
initiative to drive the vehicle by not considering the rest as important
