Legislation in relation to restrictive
interventions in health and social care
Some important legislation(s) in association with the restrictive
interventions in HSC are mentioned above:
•Criminal Law Act 1967 Sec (3): In this, an individual may use
such force that is reasonable in the circumstance in prevention of
crime or assisting in the legal arrest of the criminals or suspects
of persons unlawfully at large. It implies that care practitioners in
HSC can only use reasonable force in situation of prevention of
crimes or handling any criminal or suspected person.

• Common Law: It deals with the similar
cases that define the rights of individuals to
defend himself and his property and
decisions have made by concerning
previous cases.
• Health and Safety Act 1974: It implies that
organisation needs to maintain safe
working environment for employees and
maintenance at workplace. Equal treatment
needs to be provided to service users
suffering from mental and physical illness.

Process of implementing the least
restrictive interventions can be used
first
• Least restrictive interventions have been used to restore a
person's self-control within a short time duration, it implies to
providing them time to have a reanalyse of their actions and
change behaviour.
• It is reflected in an incident where a person is displaying a
challenging behaviour and facial expression and tone of a staff
members showing disapproval made that person not to want
the staff to assist her again.

Safeguard must be in place if
restrictive physical interventions are
used
There should be some laid down policies as well as procedures
such as protection rules, risk analysis, training of staff before
implementation of restrictive interventions. Individual in
organisation who using these intervention needs to be properly
trained and also abide by the rules. The entire information needs
to be documented in the individuals care plan on how to
accomplish that. Dignity as well as respect of individual needs to
be protected.
