The legislation that has been used in order to deal with capital punishment is Acts
Amendment (Abolition of Capital Punishment) Act 1984 which has made all jurisdiction in
Australia abolish the death penalty by 1985. After the formation of federal government, the
legislation was passed which has prohibited the capital punishment and abolished death penalty.

The Constitution of Australia has given powers to state within chapter V, fiorm section 106
to section 120. Further, exclusive power has been given under section 114 and section 115 in

Administration and Probate Act 1958 which provides that when a person dies without a will
and leaves spouse or domestic partner and no children the partner is entitle over the decedents
