Nursing code of practice/conduct/ethics
The Code includes a set of statements which together indicate what nurses, midwives and
nursing assistants behave like in good practice. It places patient and facility user's interests
first, is effective and safe, and strengthens trust by professionalism.
The nurses looking after Peter were not abiding to the codes of practice and registered severe
lapses in their code of conduct. No oxygen saturation level was being shared by the nurses to
each other which resulted in deterioration of his health.
Australian Charter of Health Care Rights
According to the seven rights of the Australian Charter of Health Care Rights, it is important
for the patient to receive the best treatment possible from the nursing community and the
physicians. The right of the patient to safety is the right to be able to receive high-quality and
safe healthcare such that a positive health outcome is established. Peter was unable to receive
the best of care and a severe health result was observed.
Duty of Care
As a measure to maintain the health outcome of the patient, a legal obligation in the avatar of
duty of care had been introduced in which every medical professional is liable to adhere to
the standards relevant for their profession and provide the best care (Water et al., 2017). In
the case study, Peter was not provided with the best care and the nursing professionals failed
to acknowledge the deteriorating condition resulting in medical negligence.
The concept of “Reasonable standard of care”
Reasonable care is the degree of risk and consideration that would be used in similar
situations by a normally cautious and reasonable individual. This is a norm used to assess a
statutory obligation and whether the obligation has been fulfilled (Driscoll & Masters, 2018).
In the case of Peter, no reasonable standard of care was established as the nurses failed to
observe the oxygen saturation level. One of the nurses made up the observation of the patient
which made the health of the patient deteriorate further and a death was observed.
