As per section 29 of the said Workplace Safety and Health Act, a workplace safety and health committee must
be set up at every workplace comprising of representatives from both the employee and employer side. The
main function of the committee is keeping in notice the circumstances that can affect the health or safety of the
persons involved in the workplace, promoting cooperation between the employees and the management for
maintaining healthy and safe conditions of working, carrying out timely inspections of place of accident,
exercising other duties and functions as conferred on this committee as per this Act and any other functions as
required.

Regulation No.: 2007 Revised Edition—Workplace Safety and Health (Risk Management) Regulations
Explain what the selected Regulation No. relates to (in your own words):
As per section 3 of the said Regulation, in all the workplaces, the principal, self- employed person, employer
must conduct a risk assessment related to the health and safety risks to any person who can get affected by
working in the workplace. The manner of conducting the assessment can be conducted determined by the
Commissioner. Further, these persons must take all the required measures to eliminate any foreseeable risk
that can harm any person. If absolute elimination is not possible, measures like engineering control,
substitution, administrative control, installation of suitable protective equipment to control the risk must be
taken. Records of such risk assessment must be maintained for at least 3 years. Every person who is exposed
to the risk of his health and safety must be informed about the nature of the risk and any procedure
implemented to control such risk. The risk assessment must be reviewed at least once in 3 years. Any
principal, self- employed person, employer who infringes the provisions enumerated above will be liable to a
fine of minimum 10,000 $ for offence committed for the first time and a fine of minimum 20,000$ or
imprisonment for period exceeding 6 months or even both.

employer has the duty to notify as well as report any accident that causes death of an employee or any other
person or a self-employed person to the Commissioner of the accident. If a dangerous incident has happened
in the workplace, the occupier in addition to reporting , it must also submit a report within 10 days of the
incident to the Commissioner of the incident. Similarly, where an employee suffers from an accident, the
employer must report it to the Commissioner of the accident and if he dies, then report about it to the
Commissioner of death. Further, when any person who is self-employed or not at work suffers from accident,
the occupier must take him to hospital for treatment and also notify about it to the Commissioner of the
accident. If an employer is suffering from any occupational disease, the medical practitioner who has
diagnosed him must submit within 10 days to the Commissioner. It is the duty of the employer as well as the
occupier to keep a record of every report or notification made by him for a period of minimum 3 years and also
furnish it to the Commissioner from time to time. Further anyone who violates the above mentioned duties will
be held guilty and subjected to fine or imprisonment or even both.

must be maintained regularly. Proper ventilation, lighting, drainage system, sanitary conveniences and other
necessary amenities must be maintained. Any person who failed to follow the provisions enumerated in the
Regulations shall be held guilty and shall be subjected to a fine of maximum 20,000 $ or even sentenced to
imprisonment for maximum 2 years or both.
