INTRODUCTION
There are certain marketing laws and regulations which every company has to follow. The
laws state there are some guidelines and rules which is applied while promoting and advertising
products and services. If not then legal action can be taken against firm. Along with it, laws may
vary from country to country. Moreover, there are some IPR as well which prevent business
invention, process, etc.
In report it will be described about case study of Space X pty ltd who have developed crew
dragon a spacecraft and promoted by giving an ad. This will describe about IPR right applied by
firm, confidential rights arising from it 1. Also, it will be discussed whether ad material breach
any section of consumer act 2010 or not.
1. Can Space X Pty Ltd legally replicate Crew Dragon?
Intellectual rights property rights which arise from the Crew Dragon & the Space X?
It is found that Space X has built a crew dragon which is a spacecraft. Thus, the IPR help
and protect companies invention and discoveries for not getting copied by others. With that it
enables business to obtain competitive advantage in market. Thus, it can be found that the IPR
which arise from crew dragon is patent and trademark. The spacecraft is patent because it has
been built and designed by Space X. The element which attract patent is crew dragon
manufacturing. Hence, under law it prevents other companies to build same product or
spacecraft. Moreover, another IPR is trademark 2. This is because spacecraft built shows original
work of Space X. Therefore, other firms can not use Space X symbol, name, as spacecraft is
recognised with help of their own symbol. Along with that, the organisation has not registered its
symbol as it directly gives them competitive advantage in market. Here, element which attract
trademark is Space X name.
Similar company to compare as competition- Blue origin is privately owned aerospace
firm which is founded by Jeff Bezos. It can be evaluated that there are many spacecraft which is
produced by firm. Thus, its trademark is unique it means the logo of organization. The founder
of Amazon created this firm. There are various spacecraft which is being developed by Blue
