Introduction
To have sound health is a human right and is useful for creating primary human rights
that affect the growth of legal obligation within hospitals. Maintaining confidentiality in records
and safe anti-discriminatory practising are useful for health industry. There must be equality and
diversity in their standard rights which are useful for them as per health hospitals (Benjamin,
2020). The hospital chosen for this project is National Institute for Health and Care Excellence.
It was founded in 1999 and is headquartered in London, United Kingdom. This project is divided
two parts. Part 1 is related to different legislation of confidentiality and effective methods of
storing data. Further issues and roles which are used for equality and diversity in nature are
discussed. Second part is related to two case studies.

2.1 Summarise the legislation/charter relating to confidentiality
General Data Protection Regulation is a regulation which requires businesses to protect
the personal data and privacy of its users. In January 2012, European Commission set out the
plan which was beneficial for data protection and brought out a systematic platform in order to
provide for appropriate agency regulating the data in the digital age (Praschma, 2016). One of
the major key component of their reforms are introduction of the general data protection
regulation. All of the norms are highly related to the different situations and their implication on
the hospitals.
The reforms are set and designed in the new form to reflect the world where we are living
and bring different laws and obligation including major personal data, privacy and consent. This
will include major social media platform, banks, retailers and many government institution
which are capable of being highly affected with their own confidentiality (Carpenter, 2020). The
list of data which is provided in GDPR are; some basic information which are related to their
personal content such as name, address and ID. Major web data which are related to location, IP
address, different type of health and genetic tags. Biometric data which are used by hospitals and
some other personal data that are required by the hospitals to treat their patients properly. Sexual
orientation and political opinions are also connected with the GDPR reliance and their own

regulations, 2021). In UK, the current impact on the society and due to Brexit, as the UK
government said that GDPR will work out crucial benefits for the country despite the country
leaving European Union and ceasing to remain EU member. This law is very helpful in
conducting the safe and secure environment for the EU citizens. This one law is established
across the continent and specifies the rules which are helpful for the companies and different
hospitals in order to protect the data of personal information. All of these information within
health care sector are relevant for the nurses and midwife. To secure their information and
keeping that information safe is very important for the health care industry.
2.2 Evaluate the effectiveness of methods of giving, receiving and storing information
There are various methods which are used for ensuring effectiveness in order to provide
giving, receiving and storing the information. While in the context of healthcare this is very
important to save the useful data which is used for receiving and storing information in their
particular hospitals. Confidentiality is the basic concept which is referred as the non-disclosure
information which are received by medical practitioners in the course of relationship
management with some patients. There are many ways which become the reason for protect
patents confidentiality and store their information related to the concept of giving nature. These
methods which are used by healthcare staff like nurses, doctors, midwife and many more and
related to stored information. These are included as trust; medicine are all related to the concept
of trust, as it will disclosure the result in order to maintain trust (Cheng, 2019). Another benefit is
digital hacking as it was related to most important information which must be kept secure and
safe within hospitals. In the health care industry the role of their implication are increased by
120%. Another benefits of legal disciplinary action which are created due to breaches and failure
of different patients within hospitals. It is important for the healthcare hospitals to keep the
effectiveness and using different methods for giving, receiving and strong their valuable records
within their departments.
There are different ways which are used to store and keep the data information in an
ethical manner. They can easily create policies and confidentiality agreements which are helpful
for hospitals to keep their view and safe (Dimitrijoska and Ilievski, 2016). Further hospitals can
also provide regular training that may affect their team members to work in an organised manner.
Restrict the use of mobile phone within area where data is stored. This are all proven beneficial
for the hospitals in order to keep data safe, secure and store carefully. Further it can be said that

nurses are able to give different type of services and patients give back to feedback which are
useful for their own progress and report of the staff. Many of the nurses and care setting people
are able to make formal, summative and informal feedback which are helpful and essential to
them and analysis major changes to different customer, patients, peer, trainees and every other
person. Nurses are needed to make high level of communication as many of the patient are able
to make their problems with nurses or care taker staff.
2.3 Analyse issues relating to confidentiality in the care setting
After analysing the importance and effectiveness of confidentiality within healthcare
setting, are important for the concept of generating issues and work for providing relevant issue.
Some of the issues are related to the concept of confidentiality which are described below:
Challenges in management: Insufficient law and different legislative requirement will
make the impact on management team. This will further create challenges for
management unsolved. For making confidentiality approach it is important for hospitals
to have relevant growth (Flynn, 2017). But most of the hospitals are not able to compete
in management where they are easily able to work in confidentiality workforce.
Challenges in hospitals' ethics: To secure the process in health system to secure the
process and many electronic health background. As the information is kept in electronic
form, as they all are recorded by making their own password. All of these are making big
challenges in hospitals-al ethics and standards. This challenge create the chaos within
hospitals if they are not able to work in an organised manner. Confidentiality will make
hospitals' ethics and effect the growth of healthcare company within industry.
Challenges in physician patient relationship: As if hospitals are related to the concept
which are beneficial for confidentiality. Further this will create informal relationship with
patients. This challenge is particularly work in physician patient relationship with
hospitals. This is somehow related to patient's right which indirectly related to
sociological manner.
All of these challenges are face by the respected hospitals and their healthcare employees
who are ready to work in confidentiality, legal and ethical environment of hospital culture.
Where a client is absolutely related to the major success in client choice, the method of adoption
for their own growth and happiness and further they can raise the issue if they need to know

about their any treatment form the hospital authority. It will further related to confidentiality of
the hospital authority.
3.1 Explain the personal contribution of the care worker to promoting anti-discriminatory
practice.
This is very important for the hospitals to work in personal contribution which are related
to care workers to promote the growth of anti-discriminatory practice (Leah, C., 2018). Anti-
Discriminatory practices are needed to be promoted within healthcare hospitals as it will create
an aim and improve the quality which make the growth of an individual's life regarding disability
and impairments. There are mainly five ways which are useful and contributed personally within
care worker which are try to promote anti-discriminatory practise during their own environment.
First step is to make understanding which are related to care providers to show some sympathy
within hospitals at personal level. Second concept is involving as the care worker should involve
their involvement within hospitals during promoting anti-discriminatory concept. Third step is
providing their own services with full information that make a significant. Fourth step is asking
means care workers should ask the service user about their need and demand (Logan and et.al.,
2017). The care team like nurses, midwife, dietician and physician will be needed to involve in
their decision and result show the change in anti-discriminatory practise within any health care
hospitals. Last step to serve their patients is priority, the care providers need to implement their
programme and make sure about that the need of first priority of care providers are their patients.
All of these are helpful in contributing the concept that beneficial for the growth of health care
providers.
3.2 Summarise own role and responsibility in terms of being accountable for Equality and
Diversity within the care setting, to support meeting the equality objectives of the hospitals
Equality and diversity are the essential components which are related to health and social
care. It will help the company to work in an ethical and diversifying nature which make sure
about fair and accessible treatment. This is very important for the company that they should be
able to make equality and diversity so that their employees are able to work in ethical manner.
The main role and responsibilities for conducting fair treatment are commitment to
equality, diversifying and human rights. Further they should be aware of equal opportunities
policy and different practices (Lee, 2020). Proper communication is require to promote both
equal opportunities policies on a regular basis. All of these concept are related to chosen

hospitals. This seems important to work in an right manner to being accountable for equality and
diversity within care setting.
Some major objectives of the health care industry are related to equality which are
important for the growth of conceptual management system. There are various objectives which
are suitable for the company at different levels within employees are their strategic approaches.
Equality of opportunities are work for the people like nurses, Midwife and cleaning staff who are
protected for the hospitals. Further it will eliminate the unlawful discrimination and fostering
good relations are considered. All of these objectives are useful for working in a healthcare
environment and work in right and ethical manner.

4.1 Differentiate between personal rights and choices and legal rights
As per the given case study, it is understood that according to rosemary’s personal right.
She has a right to decide whether she wants to live or not. As per a person's legal right, its her
own life and when she is not ready to accept her disease and not being ready to be a burden on
her family (Mantelero, 2017). Then she must have a right to decide for her future. But at the
same time as per the English UK right, euthanasia is an illegal concept. As per the legal law both
euthanasia and assisted suicide are an illegal factor. So in rosemary's case study she has a right to
decide and make decision related to her own life.
4.2 Explain factors which potentially affect clients’ rights
There are major factors which are directly or indirectly affect her right as per her own decision
regarding her life. Some of the factors may described below:
Abuse risk: This is one of the main factor which affect her decision, as she was
neglected from her family and unwanted restrictions on her life will increase her desires
for euthanasia (Sanchez Nieminen, 2018). This factor affect her mental stage and would
not be able to survive in environment that make an impact on her decision for being alive.
This can also related to the changing nature of her life and it will make an impact on the
growth and admire of her living status.
Socio-economic factors: These factors related to her income, health, community
discrimination and no social support. All of these are become the reason for choosing not
be being alive. This factor affect her life and change her mental ability within specified

suggested diseases. Socio economic factor at the same time affect the growth culture
factors, as she’s nature, culture are totally different from the mental stage.
5.1 Examine factors which influence the development of identity
There are various factor which affect her identity development programme and supported
strategies are helpful for provident a support to live her life happily. Such factors are culture and
ethnicity; as these factors are supportive and complete their need which are required in culture
and ethnicity (McDonald, 2019). Another factor is gender role, as it will help rosemary to feel
her pain and stress out from her own situation. And in last family role is an important factor in
order to develop her own identity. These factors somehow effect and relate to the development of
identity which are useful for the patient’s point of view.
5.2 Analyse how care practice can support basic human needs
While it comes to NIHC it is defined that different care practices are used in order to
support the basic human needs for patients (Pikramenou, 2019). They are the ones who needed
more support and care which help them to increase their enthusiasm to live more and support
their healthcare culture. There are many ways which are adopted by NIHC as they provide full
medicine dose with proper caring, full of natural and healthy environment within their hospitals.
5.3 Analyse ways in which beliefs and preferences may affect care delivery
The personal belief and preferences may be sense of wellbeing nature and could help a
patient for removing or reducing their pain and negative aspect of life (Nipperess and Williams,
2020). This may also lead different patients’ requirement in order to complete procedural and
other methods which are beneficial for clinical interest or even a patient can remove their
interest. Further the preferences also help the care delivery team in order to work and implement
the life-saving procedure. This will stop the uncertain demand or medicine which may make an
impact on affect the care delivery report.
Conclusion
From the above report it is concluded that the need of being confidentiality, safe and
secure environment within a healthcare hospitals. This is one of the beneficial choice and help
the management team to work effectively which are associated with health care team. Some
patients are go through with lots of mental trauma so they are in need to suggested basic support
as per healthcare need and regulation.
