Part-A
The Children and Young Persons act establish in (Care and Protection) Act 1998, is a
legislative framework that govern the wellbeing of children’s. It provides various methods of
child protection and out of home care services in NSW. This section states and provides a
legislative summary of the framework that supports wellbeing of a child and protection of a
child including the updates of the safe reforms. The overriding principle of this act ensures
for safety, wellbeing of the children and welfare of young people with paramount decisions.
The objectives of this act are to provide (Children and Young Persons (Care and Protection),
2019).
ï‚· Children and young person always receive protection and care that is necessary for
their safety, taking into account of welfare and wellbeing. The power and all the
duties of their parents and other persons are more responsible for them.
ï‚· The institutions and facilities are taking into account for the protection, care and
persons with young age provides environments with free violence and exploitations.
The service provides foster their development needs, self-respect, health and dignity.
ï‚· The appropriation of the assistance is rendered to the persons and parents, and they
have responsibility in promoting safe and healthy environments.
The main principles are applied to administrations of this particular act in welfare of
children’s. The stated principles are mentioned below:-
o All the actions and decisions which are made under this act with the legal and process
of administrative, concerning child and young person safety, welfare and wellbeing of
child must be with paramount considerations.
o The own views of young person or child is able to form on matter concerning their
welfare and that has an opportunity to represent those views freely in accordance with
capacity of developments with the circumstances of child and young persons.
o The actions made under this act tells about child must be taken care of the disability,
religion, culture and sexuality of the other person and the main contributions and
responsibility with parental supports.
o The necessary decisions that are taken into account in order to protect child or young
person from causes of harm, the intrusive interventions in life of a young person and

his family which is consistent with the concern protection and results in promoting
development of child and young persons.
o If child is deprived temporarily or permanent with his family environment, the state
will protect him for the name, culture, society and religious. The family environments
which create tensions and less protection to the child will have write to assistance
from the state.
o If a child or young person is actually placed in the condition of out of home care,
there is a situation of close relationships with people from significantly person,
including siblings, peers, family, parents and the communities where they are living.
And if there is a situation where child feels discomfort, then he can take actions for
their measures.
These all principles help to guides the practices the concern about child and young persons
and motivate them to be performing for better living in their lives. Child safety applies the
paramount principle in every time about the child care and the wellbeing of the protection is
made. The appropriate assistance guides and takes decisions of children and young person
with rearing responsibilities in promoting safe and nurturing environments. The government
used to take various decisions that guides and give importance to the children and give
practices that are implemented for child protection.
Children and young persons (Care and Protection) Act 1998 is an NSW principle that guides
the principles practices with the administration of this act. The focus is on the development of
child who is of young age and provides them with basic facilities to grow, and if they are
dealing in some problems then they can see the guidelines stated in this Act. Children and
young people (Care and Protection Act). Care and Protection Act establish the consequences
and practices that are being developed for the children and young persons for their healthy
living. The implementations and principles that guide support to help and care for the
wellbeing to adjust with the latest methods to approach with the situations are to be
implemented.
Part-B
The practitioners need to apply these principles that help to grow with the practices in
consideration to children in out of care (OOHC). The designing of the services which is being
provide for policy makers about young people and children’s who are living in out of home
care in Australia. Out of home care is the actual care of the children who have a age between

0-17 years and that are unable to live with basic facilities of caregivers (What is out-of-home
care?, 2019). The national framework protects Australia children in the state that OOHC is
the last resort that can help the children in safe conditions. The main focus is for providing
support to children and families so the child can feel safe and stay at home is the preferred
option. When home environment is not safe for young child, they are placed in OOHC, with
the focus to provide safety and sense of security. There are different types of OOHC care as
residential care, family group homes, home based care for children and young people,
independent livings and other constitutes of placements or boarding schools (Children in
care, 2018).
The child protection practices need to be reconfigured and that ensures safety in the culture
for families of indigenous people. The rate of the indigenous children and their families were
over represented in OOHC across all the ages’ group (Out-of-home care (OOHC), 2019).
There are multiple perspectives and mechanisms of dynamic to promote systematic
wellbeing. Indigenous children remain significantly less healthy than other children’s and
there is more consistency of their health and NGO are taking major steps to promote these
services that provides healthy living of those child who are living out of home care
( Fernandez, Lee, & McNamara, 2018). Approximately half of the children’s in Create
foundations received more information regarding this. The practice of AIHW and CREATE
foundations helps the vast majority of children’s in securing their placemen to and healthy
living lifestyle where they can secure themselves and face number of challenges ( McDowall,
2019).
Question- 2
The case is about Rachael and Mary who are children of young ages and Sophie is a mother
of these children. The practitioners need to apply such principles that are relevant to child and
young person’s practices. As a case worker in a community services, I have the authority to
have statutory direction in the practices of child welfare that protects him for longer period of
time. DECIDE model helps to guide the active principles in this case of Rachael and Mary
who belongs to small rural town in NSW, Sophie is the mother of these children and do not
take care of them and active in wrong practices with Joe. Mary is suffering from Down
syndrome and she wants special care of their parents and sopfie is the only care taker of them
as her father not lives with them. The medical attention she is receiving is from NGO as they
help her in getting faster recovery for the children who are disable. Decision making is the

process of making active choices by identify the decisions taken by other, gather all the
relevant information’s and then assessing the alternatives and provide feedback to the
concerned situations. This is a step by step effective process of taking decisions by
organizing relevant information and definitions of the alternatives (May, 2019). There are
various methods and approaches which help to guides the practices of children in out of home
care and support to their families regards the same. The applied model of DECIDE has being
made and that ensures ethical decision making with the case study to be focussed (Models of
decision making, 2019). Decide model helps to identify the situations, measure in detail the
performances, the process of evaluation can be measured and the corrective actions which are
to be taken in the particular situations for the better results.
After visiting to home at Sophie house, I observed that there is associated risk with the
children health and no actions are taken regards the same for improvement as Sophie is a
mother of child, she should take care of the health and proper growth of the children. Child
protection is an act that provides protection to the child and grows with basics and best
services by government and states. I have received three reports which have fair connections
with Rachael and Mary. The neighbour has reported that Sophie left their kids alone in night
and there is no care taker of their health and well-being. The second states that Mary is
suffering from Syndrome disorder and Sophie know about all these, the healthcare
professionals are helping the case and NGO is taking healthy care of Mary. She is so small
and cannot take care of her own health, the third report states that she is being founded in the
soiled nappies and that have effect on her health and has severe thrush, and with all this
awareness, Sophie is not corrective actions that can make her happy.
Ron is the person who is involved in the relationship with Sophie, and one night he came to
her house and shouting on the children who are too small to understand their drunken
behaviour. Sophie has disclosed that in her further report of this incidence that is being taken
care by the community services and departments of the family. My perception of handling
this case is more drastic and difficult as how Sophie is reacting to all these situations is
annoyed to me. The several steps that are being considered in the actual process of taking into
account for implementing DECIDE model (Guo, 2019).
DECIDE model can help them to effective take ethical decisions to apply changes in the lives
of Rachael and Mary as they are getting what they want in life and these affect their health
care of lifestyle. DECIDE is the combination of six letters and each letters states the

situations from defining the problems, establish the real criteria, consider the alternatives,
identification of the best alternatives, development of the implemented plans to take actions
and last is monitor and evaluate the required solution to the problem (DECIDE - Decisions
Making Model, 2019).

For ethical decision making in this case, there are various stages that are to be taken in
considerations of Rachael and Mary health and wellbeing. The first step comes with

solving of the process aims to reduce barriers in achieving individuals and most of the
situations goals. Mary is two year old girl who is suffering from Down syndrome. Down
syndrome is a genetic material that is staring in genes. Genes carry all the codes
responsibility that inherited traits and that is grouped along rod like structure called
chromosomes. Down syndrome occurs with the individual in full or extra partial copy of
chromosome (Down Syndrome, 2019). This is the stage where identification of the Mary
problem has stated and that clears the nature of decisions to be taken. This is the first step that
is taken into account for further proceedings. Sophie is more involve with Ron, and is less
interested to the care of her own children’s.
In establishing the criteria of the matter, there are problems that relates with all the three steps
which is being recovered by community services and departments of the family. To go to the
places where Sophie has her home, the certain things are in front of eyes to recall and
establish the favourable concerns. The alternatives considerations results in Sophie has
disclosed with the matter of Ron that he has come to my house drunk in late night one
evening and woken up the children and say wrong words to them as this is not fair in regards
to the situations that is happened. The bad behaviour of Ron is the result of all these
consequences that has happened and I have research with all this study. The ethics of
decisions making states that these are the wrong practices that Ron should be punished or
taken into account for the safety of family and the children’s.
Development of such plans should be favour to Sophie to take care of her family that is his
children who are suffering from bad situations in the present. The ethical decisions took place
should be form that provides safety and security to the people who are underage and the
government should take further actions for bad persons in these type of situations. The case
study establish the perception of the mind to give advice to Sophie that she should be more
aware of the new things and help her and his family first. The care of family is the first and
foremost step that helps to boost from giving special care to their children’s.
The reports suggest that there should be proper follow up for the actions which are taken by
Sophie and she should be guilt for the same and never repeat them in future for further
proceedings. The community services and department of the family should be more involve
for the implemented actions that covers the wellbeing of the both the children’s. This model
will eventually guide the decision making process and there is flexibility of the structure to be

followed that evaluate the functions of DECIDE model. The review can be done with the case
of Mary and Rachael as they should be fairly treated with her mother for the healthy lifestyle
and at least basics of life are required by Sophie to take. DECIDE model helps to builds for
this care of Sophie to take effective actions that are to be taken with the guidance to decision
making process easier.
