Introduction
Homicide can be justiciable and non-justiciable. All kinds of homicide are against the
humanity but they are not punishable. Only the unlawful homicide can be punished. Law
exist to prevent all kinds of crimes that are against the humanity and it prevents the situation
of chaos from the society. One of the incident of homicide happened on Merton Road
around 11- 11:30 PM on 14 August when a male cyclist was knocked down. On the spot of
crime silver Audi A3 was seen. From the scene of crime the bicycle was missing which was
red racing bicycle. The silver Audi3 was there with wife of the victim of the crime and other
evidences were also in support of the fact that she was the one who caused the murder of her
husband. Therefore she must be booked for the charges of murder. The reasons traced for the
same are discussed below, due to which her guilty has been analysed to be proved, these are:

 One of the witness (James Mountford) of the scene asserted the fact that she show the
Silver Audi at the scene of crime which was in speed. However she did not asserted
anything for the bicycle. This independent testament of the witness clearly support
the doubt against the wife of Marcus as she was owner of silver A3 Audi and the
same was seen by the witness (Klein, 2012).
 The police report on the status of Marcus Donoghue’s Laptop exposed the fact that he
was found to be engaged in the extra marital affair through a dating website. This fact
indicates that Marcus was not happy with his wife and therefore he was approaching
for affair through the website. This can be one of the reasons of causing murder of
him by his wife Jinnifer since he was very rich person and she must have worried
about the wealth and to get the ownership of entire property and business of her
husband she caused murder of him in a planned manner.
 The statement asserted by Jennifer Dongheu to police that she was not at home on the
date of accident and she went to her sister’s home in Little Molling to look after her
dog when her sister was not there. She accepted the fact that she normally derives the
Silver Audi A3 but she at the same time denied the fact that at the date of accident
she used her sister’s Volvo to protect her own car from scratch by Labrador. These
facts seems to be manipulated as she could have taken care of her sister’s dog even at
own home as well. The denial of fact that on the day of incident she did not use her
car also cannot be accepted since it seems part of the fabricated story.
 The fact of not finding the bicycle at the scene of the crime also indicates the fact of
murder. The same was set to bonfire however the signs of red paint were found. The
bicycle was found in the place that was in the control of Jennifer’s brother. This
clearly proves the fact of involvement of murder of Marcus by Jennifer only (Brown,
2012).
 Sara Alaam who was receptionist and PA at Queen of Hearts stated that Marcus was
having the big concern about his marriage and it was always a fraught relationship.
The marriage between two of them was happened on fraudulent exercise. Before the
accident as he told that he cannot forgive his wife for cheating with her. The
independent witness of her is supports the suspicion towards the fact that Jennifer
caused the murder of her husband since to got married for money only she exercised

the fraud of pregnancy with Marcus and when she came to know the fact that he is
having the extra marital affair her sole purpose of getting marriage was at risk and to
acquire the compete wealth of him she planned murder of her husband.
 From the facts of the case it was found that a 42 years old lady was arrested due to
rash driving. It also connotes the fact that accident was caused by Jennifer who also
belonged to same age group (Morrison, 2014).
 In the investigation by the police Jennifer did not replied to any query made by the
police and this clearly shows her non supportive behaviour and supports the fact of
murder by her only.
 The rival business owner cannot be said to have murder of Marcus only to get the
leading position since there are other competitors as well to who he is facing.
Therefore business profit cannot be made the sole ground of alleging the change of
murder against him when the other witness and evidences are going adverse
(Kinports, 2015).

Conclusion
On the basis of facts and considering the police report and statement of witnesses it was
found clearly that murder of Mercus was fully planned. The irregularities were found due to
which it cannot be considered as accidental case like missing of bicycle, finding on later date
that the same bicycle at Jennifer’s brothers’ premises, the incident of burning the bicycle.
The charges of the murder goes against Jennifer only she had the big reason to cause death of
her husband and that was his wealth, the previous fraudulent exercise adopted by her to get
married to him also supports the fact that murder was planned by her only. The witnesses
also asserted the fact that Marcus was not happy with her marriage and the same fact is
substantiated with the internet history of Marcus laptop as found by the police. The
inconsistencies were also found in behaviour of Jennifer while interrogation conducted by
the police and ground gives by her to prove her innocence are also suspicious and does not fit
in ordinary circumstances as true. Thus the guilty of Jennifer is clearly established and
therefore she must book for charge of murder of her husband and she must be punished for
the charges of the murder.
