1. About the article
This is chapter 5 of book written by Julian Teicher which defines the theme of the
relations which develop in the work place. In this chapter discussion is made upon issues related
to the development of employment regulations, the bargaining system which works for the Fair
Work Act 2009 and the role of its commission. This chapter discusses the National Employment
standards and all the related topic on both the national and international level. This chapter
discusses the unfair and unlawful dismissals under the Fair Work Act 2009. This article chosen
from this chapter is the Legal framework of bargaining under Fair Work Act 2009. In this article
the Fair work Act 2009 has been very comprehensively examined (Riesen, Thomas and Kipping,
2019). The case study in the article has explored deeply the four important sectors, health, retail
and hospitality, motor vehicle components and also the public sector. Within this article there are
discussion made on Enterprise agreements, yardstick for agreement approval, process of
bargaining for better faith approach and the roles of Fair work commission. This article also
helps with the remnant of arbitration which is determines the outcomes of the work place
determination.
2. Area of discussion
In this article there are three main discussion which have been made. These areas of
discussion are,
Enterprise agreements :
With the help of this article it has been understood that agreements are made generally
between the employers and group of employees. This therefore lead to non-union bargaining in
the workplace. Due to this the Fair Work Act was changed due to the agreements with the unions
which were into bargaining.
Agreement approval:
This article explores the activities of Fair Work Commission for approving the agreement
of the commission and it must be passed. The third party approval has been the agreement and
approval of features of the Fair Work Act. According to this there was lacking in the original
yardstick for the determination of the work choices legislation and the application of their award.
Management-General Interest :
This project mainly focuses on the interest of the general individuals. The management of

the employees in a work place and its importance. For the employees and the students which
want to learn this article has different resources (Mayhew, 2018).
3. Findings in the article
With the help of this article it has been found out that the effects of the workplace in
Australia has made its impact on the employee relations globally. This article shows how the
changes which are coming in the world economy and leading to the financial crisis affecting the
employees in Australia. This article has been successful in finding out the effects of the
employee relations on the four important sector's health, retail and hospitality, motor vehicle
components and also the public sector. article mainly focusing on workplace relations which
means relation between workforce and company. article evaluates that it is the twenty first
century, so employees should gets equal opportunity for everything whether to raise their voice,
getting benefits at the workplace or occupational health. this article also shed light on some of
the companies that how they are not maintaining workplace relations and companies who are not
properly managing their relations have to face its consequences as well. international economy is
evolving and with that company also have to face global financial crisis. the four main sector on
which this book has discussed are the most important sector. as retail sector is the vast sector and
plays vital role in the economic development of the company and the same with other sectors
also.
4. Main issues raised by the author
The critical issues which is raised by the author in the article related to workplace relations.
author focus on office relations in the whole article. as workplace relations plays vital role and
impact workers life. healthy workplace relations will retain workers in the organisation for the
long term. unhealthy workplace environment will demotivate workers and they leave the
company. Here is the role of fair work commission comes which says that good faith should
been maintained within employees. company can do many things to improve the workplace
relations. they should start valuing their human resource (Gough 2020). as human resource is the
most important resource of the company. in some of the Australian company employee cannot
raise their voice this is not accepted. That is why Australian employment law has gone through
big changes.

as employees should also gets right to share their views and opinions. workforce faces
many problems in the organisation so they should have given chance to discuss about the issues
they are facing at the workplace. workforce also have equal right in terms of salary,
compensation and other benefits. as some organisation does not treat their employees equal. this
behaviour of company can also hurt their brand image in the market. as employees only want to
work with those company which have good brand image in the market. organisation should take
care about their employees in regards to their needs and also provide them time so that they can
manage their work and life effectively.
5. Major points made by the author in terms of the issue which is raised.
Author in the article has discussed issues which is related to employee voice, occupational
health, discrimination against workers at the workplace and reducing trade union members. as
per the author the voice of employees is important and organisation should listen to it. employees
should never be discriminated but every employee should be treated equally. author also
explained that in Australia in some of the company’s workers are discriminated on the basis of
caste, age, gender, colour etc. company is also not taking care of the health of their workers (Van
Gramberg and et.al., 2020). As per employee contractor law that employment should be anti-
discrimination and offices should have policies for health and safety. Author said that interest of
weaker groups should be protected.
they should know that when workers will remain healthy than only they will work with
their full potential. companies should come up with schemes to provide benefit to their
employee. as this will motivate them to work even harder and that will also increase their
productivity. healthy working environment is the right of the employees and every employee
should get that. author in the article has also discussed about global financial crisis and effect of
globalisation on workplace relations.
