INTRODUCTION
Every person has fundamental rights and right to freedom is one of them. UK
government has taken many initiatives to protect rights of people in the country. In order to
improve health care experiences of patient authorities are ensuring that people get respect,
protection in the hospitals. It is essential to maintain equality in order to provide great care
facilities to patients in hospitals (Wronka, 2016).
Present study is based on case of Dora and Simon, they are married old age couple.
Dora is suffering from Alzheimer and Simon is unable to take care of her hence she has been
shifted to nursing home and it is decided by both that Dora will visit her regularly. But
hospital staff wants to shift Dora to permanent nursing home which is far away from his home.
Current assignment will explain rights of Dora and Simon. Issue related to case study will be
explained and discussion will be done on right of person in health care service.
DESCRIPTION
Right to informed consent is the principle that states that medical professionals have to
take consent of patient before taking any action for them. In the case doctors of nursing home
need to ask whether Dora wants to get shifted in permanent nursing home or not. If she is not
ready for the same then medical professionals need not to pressurize her. In case of Dora and
Simon those who are married aliveness of 59 years, in-spites of having blindness all over her
life make a level of undesirability towards their relationship. Recently Dora has developed
Alzheimer and on other hand Simon have already made an injury from fall at home which
makes Simon unable to take care of beloved wife in more appropriate manner. This is
considered to great issues for him to take care of her wife, so Dora has been shifted towards
locally funded nursing home which is nearby. Simon's and his children went for regular visit
to meet her wife. But the locally funded authority have taken decision to have shifting of Dora
permanently into another care home which considered to be variety far for Simon to meet his
wife at this age of life.
If she does not want to go to far location then doctors need not to pressurize her to
shift. This must be taken care by professionals that dignity and respect of person remain
maintained.

Article 8 states that there is offense of protections which is considered to be very
important towards older persons for having adequate level of arrangements which is major
level impacts towards older personal rights to have respective level of life (Cole, 2017).
Human rights means each person has right to take suitable decision for themselves, no
one can force them to change their decision. In case of medical emergency family members or
person own self can indicate doctors regarding treatment and services. Medical professionals
have to arrange all facilities according to their consent only. Nursing care home needs to take
care of need of Dora and have to ensure that Simon can easily met with his wife. Care home
can not force Dora to shift to other place until unless she is ready to get shifted. Her choice
must get respects in the hospital.
It is however to have legal arguments which is considered to human rights which helps
human services towards older people. There is major level of recommendation to have
signification lookout over transformations of health and social care services in more effective
manner (Knapp and et.al. 2016.). It has been identified that same of public bodies have
themselves adopts different use of human rightists approach in more ways of commission,
training send more over delivering of services which have led level of improvements over
signified services. Patients have right to get adequate care in hospitals by competent workers
as medical professional must ensure to give proper care to them so that their medical condition
can be improved.
Patient has right to avoid to get such treatment s and facilities in which individual is
not conformable. That means if person does not want any kind of facility in hospital then
person can refuse to get it. In case of Dora and Simon, nursing care home’s staff members
have to take permission from Dora whether she is agree to get shifted or not otherwise they
have no right to take decision on behalf of her. These right mean to have living of life without
having any level of harassment with respects to private life along with personal and family
life. The older one have the right to have privacy over their personal life which have coverage
of issues of personal choices. Relationships along to having physicals and mental level of
well-being which is providing access to personal information along with participation of
community life in more respective manner. The next is about the family and home life's which
is interpreted at broad level over having dependence in various circumstances with having
close personal ties.

This right is considered to be qualified rights which may have following of restrictions
as per basis along with having pureness in legitimates aim which is being set out in human
right act along with having necessary changes and appropriates dependence. This has
meaning of that in some circumstances, public authority will have legitimate right to have
interference in their privates life in order to have protections of public safety which is been
freedom from other in more respective manner.
DISCUSSION.
Human right act 1998 is made to protect fundamental rights of people. Article 8 of this
act explains that medical professionals need to give respect to the person and their family both.
As in the case Simon is unable to come to the permanent nursing care home because of his
injury he is unable to come to that far location hence medical professionals have to understand
problem of Simon and has to take care to Dora in existing care home only. As per human
rights and European conservation which has been developed for uprising quality of standard
of life of human in term of older people to have enjoyment of their rights for respective
manner. As per article 8 in European convention, there is protestation of rights in order to have
respects in terms of their private life and family one in correspondence to home (Stein, 2017.).
It is all set out to be in general term which are considered to be circumstances when it can be
more level of interfaces with have acceptability of rights where its is been majorly justified.
This considered to be qualified right where any level of interference should be justified to be
taken in accounts as per level of individuality or differ level of community development. An
appropriateness of response towards problem should not have excessive level of interference
towards exploitation of human rights in order o have decision-making. In the case of Dora and

level of overarching which ca be major parts of raising issues in personal life in development
the human right. It is staff to have legitimates reason with more level of it holding information
which is raises types issues which ars right to have respects for private life. Care home
placement is considered as important and life changing factor of human beings who are
actually facing major level of issues in discussion the factor in more prominent manner

is creating one of major issues under right of respects over family life's. They have right to
have respects of private life's have clear indicators major considerations which is needed ti be
taken by older people before making ant decision in respect to them.
As per case there should be performing of public company in various aspects of Private
family under section 8 to have human rights. Its was simply been argued that load's authority
have breaches right of couple in more significant manner (Liao, 2016). The nursing should
have to take clear consent with family of direct regard to her shifty permanently to another
case. It is been discussed as one of older person who is living in care home or hospital for

longer period of tine, then place will be considered to be their home which is in realization is
actually right to be developed more case, therefor can be any decision to have a move of older
person in order to another of different care home or hospitals needs to have give respective
rights to patient along with family. The respects of private life is need to major considerations
as older person is moving from care home where they have for longer time as impacting in
more serious way of their life. Thy have fear to lose there friend and family which is
impacting life in more prominent way.

In the light of above it has been clearly that the article 8 has been discussion over the
critical aspects in society performing equivalent measure over development in significant way.
