been given to the users of health sector. One of the major role that is played in this regard is of
communication (Antheunis, Tates and Nieboer, 2013). A firm must take care of the privacy and
promote the management of risk. This reports highlights all the policies that are changing the
working mechanism of the health care settings. It also showcases the tension that arise while
balancing the individual's right. It also reviews the current position and structure of legislation
that is changing the medication facilities and justifies the effectiveness of every policy and
procedure along with the approaches being followed by the managers.
TASK 1
1.1 Current legislations and sector skill standards that affects the organisational policies and
practices
Legislation refers to the laws and policies that are made by the government of UK in
order to regulate, authorise, sanction, grant, declare or restrict all kinds of ill practices.
Legislations of a nation impacts on the operations of several firms. UK legislations have
impacted on the promotion and maximisation of rights of health care users (Belling and et. al.,
2011). Like Health and Social Care Act 2008 suggests that every health and social care service
provider must have more than one registered managers. This registered individual is responsible
for maintaining the rules and regulations of health and social care industry.
Social Services and Well-being Act also influences the health and social care user's
rights. This act defines the framework for health and social care firms. It promotes equality,
enhances the service quality and increases access to the provision of information that individual
receives. Various kinds of legislations for empowering UK’s population are as follows:
Power of Attorney Act 1971
Health services and public Health Act 1968

Apart from these, there are some sector skill standards which are also beneficial for
maintaining the health and social care service user’s rights. It can be defined as a set of standards
that have been made for executing all the activities in health and social care sector. Such
standards are the benchmarks which must be followed by the firm in their procedures and
policies in order to empower user's right. There are several rights of the users that are
empowered by effective legislations on the firm's policies (Cameron and et. al., 2014). Code of
practice for Social Care Workers emphasises on roles and responsibilities of the service
providers, service workers and other stakeholders in fostering empowerment of users.
1.2 Factors affecting the achievement of promoting and maximising rights of health and social
care
In health and social care sector, services users have many kinds of rights. Rights of these
users are affected by several factors. The health and social care service users have a right to get
appropriate treatment. These rights can be affected by several policies and service system of the
firm. Maximising and promoting user's right is also influenced by human resources of the firm.
Human resources must have appropriate skills and knowledge since it relates to provide proper
treatment to the users.
Technological advancements: Technology is another factor that has higher influence on
the rights of users in health and social care. It is necessary that firms take use of the most
advanced technologies in order to provide better treatment to users (Fotaki, 2011). There
are many complications that are related to the use of technology as well as ensure
privacy. Hence, it has to be properly taken care off.
Anti-discriminatory processes: Apart from this, a company must take care of the issue
that nobody would get discriminated on the basis of culture, disability, social class,
sexual orientation, race, etc. All have the right to get the same amount of care services.
Policies: Policies are other major factor that influence the promotion and achievement of
promoting and maximising rights of health and social care. Policies help in eliminating

negative outcomes from the operations. Like making of ramp within the organisation is
an extra facilities that can be provided to the users who are disable.
Procedures: These are designed so that health care setting will follow it to provide
services of higher quality to the users (Moule and Hek, 2011). It helps in the execution of
policies at the workplace and in whole firm.
Economic state: Many a times it is also an major factor. If the firm is economically weak
then it will be unable to provide better quality services to the users. A firm that is having
abundant resources are able to achieve and promote maximising rights of users. If
economic health of organisation is good then they are able to provide infrastructure that
supports every section of the society.
1.3 Analysing ways in which communication contributes to promote and maximise the rights of
users
Communication is the basic need of organisation’s smooth operations. Maintaining
standards of communication in between care workers and individuals helps in providing better
services to the users (Munn-Giddings and Winter, 2013). Care workers provide services to the
people like nurses, doctors, technical employees, etc. Employees have the responsibility that they
adopt and practice the communication standards that are in favour of maintaining standards of
services. In case any gap between patients and care workers arise then quality of service will be
poor. For example using good communication methods with the patients facing Dementia can be
useful in making him feel better which is essential for making them well. In this case
documenting can helps as she forgot everything. Another example if the user has habit of eating
food that are of different variety which is not possible to provide by the firm and eating from
outside may worsen his condition. Then in this case persuading technique of communication can
be useful as it will help them to understand its personal health condition. In such cases, role of
care workers becomes highly important.
Apart from this, communication helps in understanding the needs of the patients as well
as explaining to users about the services he is getting from the firm (Rigby and et. al., 2011). In
case of any discrepancies occurring in communication mediums, it may be possible that people
will not be satisfied with the services which he is getting. This also helps in making the
professional relationship within firm. The role of technology has become highly important in this
regard. Firms have started making services faster in such case use of telephonic can be highly

3.2 Effectiveness of procedures, policies and managerial approach within a health care setting
for promoting the risk management.
Every organisation need to set up some of the policies and procedures that will help
them in running the business and also achieving the organisational goals.
It is the role of the top management to make all these.
Firm must have a legislation regarding the acceptable and unacceptable risk, creating an
environment that is abuse free.
Basically the leadership is responsible for promoting managerial risk.
Firm must set up a procedure for complaining (Ocloo and Matthews, 2016).
Identification of possible problems or abuse is beneficial in this regard.
Screening of the individuals who are ready to reduce the abuse.
Correct procedures for reporting could help in promotion of managing risk.
It is to be understood that policies helps in controlling the ways in which health care
settings are performing. Better the policies better is the chances that staff members will
be bound to perform the activities with their specified limits and they will not get
involved in further practices in future (Read and Maslin-Prothero, 2011).
On the other hand the role of the managers within the firm becomes more crucial as
they are the handlers of all the activities that is going on inside the firm. Managers do
apply different approach for such purpose but the most effective approach in this regard
is clean control. In this managers take control of every activity but allows workers to
freely work inside their limits. Since every worker has to report to managers hence
