Introduction
With the changes in time, there are several theories which emphasis upon the actions of the
person in the particular situation. In the given case, it is found that the incident of killing took
place when the accused found her girlfriend getting indulged with her lover making
intimation. The main reason of killing that girl was based on the fact that she found her
girlfriend with Chef her lover Amin Sthapit. This report has reflected the use or implication
of the different theories such as Utilitarianism, Deontology, Virtue and Contract theories.
These theories have shown the proper judgement and various other factors which may impact
the acts committed by the accused (Fryer, 2016).
Utilitarianism theory
In this theory, the pleasure of the particular felling and the actions entered by the person has
been taken into consideration. It is evaluated that the Utilitarianism theory reflects the actions
and outcomes taken by the accused out of the pleasure of the feeling. The Utility is used to
divulge the well-being of the sentient entities which depicts the actions undertaken under the
particular situation. The defencing way to save the accused could be based on the form of the
results which was found on the basis of the pleasure undertaken in the particular situation.
The standards and facts which describes new version of the consequentialism and the facts
has been divulged the right and wrong actions under the particular circumstance (Lucas, &
Galinsky, (2015).
It is considered that combination of the pleasure comes from the form of the results which
might be deviated from the current mind set of the accused. In the given case, Utilitarianism
theory has been used to identify whether the act of the accused was right or wrong. However,
in the given case, it is considered that her girlfriend Geecy Rebucas was indulged in doing
intimation with her lover Amin Sthapit. After seeing that scene, accused got disappointed, felt
sorrow and had pain. It resulted to the loss of his mental condition and he murdered her for
the same. The Utilitarianism theory divulges that the act of the accused was right as per the
general point of view. The act of her girlfriend was not right but killing her for the same was
also not right at all. Nonetheless, his aggression killed her girlfriend and at the time of that act
accused was not in her right mental situation. The instant action was the result of the feeling
pleasure of aggression (Lucas, & Galinsky, 2015).

The Roy Abanales Tabalbag was indulged in guilty of manslaughter and murdered her
girlfriend. The defence was made in terms of Utilitarianism theory which reflects the act of
pleasure coming out from the particular situation. After seeing her girlfriend in her situation,
he lost his control and murdered her at spot. The Utilitarianism theory cannot save the act
committed by him as the act was neither legal nor ethical in general terms. Nonetheless, the
mental condition might be considered to prepare the proper defence.
This Utilitarianism theory emphasises upon the feeling, pleasure of work, aggression and the
circumstance in which the act was committed (Winkler, and Duminy, 2016).
Deontology Theory
The deontology theory focuses on the morality of the action and act undertaken by the
accused. This theory is used to judge the morality of the action in the specified circumstance
in that accused murdered his girlfriend (Bostyn, Roets, & Van Hiel, 2016).
This deontology theory emphasises upon the obligation, duty and ethics which required to be
undertaken to judge the particular action and moral obligation of the concerned persons
(Albee, 2014).
There are several ethical, moral and duties which should be taken care by the accused in his
act. However, at that time, he was not in his right mental condition due to negative situation
and wrongdoing of his girlfriend. The morality of the action is based on the particular
circumstance. The religious laws set of rules, regulation, social values, and belief. In the
given case, accused murdered her girlfriend as he could not see her intimating with others.
The crime of murder was not unethical as per the deontology theory. The deontology theory
shows that each and every person should act on the basis of proper mind control and should
not take hustle free decision. As per the deontology theory, the act of the accused was not
ethical and the act was based on several other factors (Bell, Dyck, & Neubert, 2017).
The defence of Tabalabag was related to loss of mental condition. The deontology theory
emphasises upon the morality of the acts which was committed by accused. He murdered her
girlfriend which was not good and his act was not at all moral (Treviqo, & Tilly, 2015).

Virtue theory
The virtue theory emphasises upon the intents, characteristics and benefits of the person.
Each and every person has their own virtue such as inherent characteristics, intents of mind,
inner strength and developed core aspects. The virtue theory emphasises upon the quality of
persona and his own intents which makes him more viable to the particular situation. In this
given case, act of the accused to murder his girlfriend was neither ethical nor moral. It was
the acts of his aggression which spontaneously resulted to killing his girlfriend. It is found
that if a person could use his virtue to control his anger and happiness then he could easily
avoid the possible issues and problems (Winkler, & Duminy, 2016). The accused did not
have the virtue of self-control which resulted to the negative action. He had to suffer so many
issues and problems due to his uncontrolled act of killing his girlfriend. It could be inferred
that the virtue theory focuses on the intents and positive factors of the person and their uses in
the particular situation (Drake, 2016).
Contract theory
The contracts theory has several rules and regulation to maintain the peace of harmony int eh
work process system. In the given case, it is observed that each and every person should be
collaboratively working for each other benefits and obliged to behave morally if there are
explicit rules. These rules are equal for everyone and followed on equal basis. In the case, it
has been considered that, accuses killed her girlfriend on the basis of her wrong act, which is
illegal in the society. It is inferred that killing could have been morally permissible only when
the society does not have implicit and explicit rules, In this case, the act is neither right nor
ethical, and would be considered as breach of contract theory due to the wrong doing of both
parties (Shestack, 2017).
