A witness statement is used to provide a written record of student’s performance against targeted assessment criteria.
The individual completing the witness statement should be knowledgable, skilled and competent in making judgements
about your competence. The individual completing the witness statement may not have direct knowledge of the
qualification, unit or evidence requirements as a whole, but who is able to make a professional judgement about the
performance of the student in the given situation.

Interpret the law in relation to the key ethical and professional practice themes in health and
social care.
The health & social care act 2012 which is responsible for providing most extensive
reorganisation of structure of healthcare organisation. It includes to follow professionals practice
themes by care providers such as promoting and protecting the interests of patients and carers.
Meanwhile, it also consist effective & appropriate communication, perform within limitations of
own skills & knowledge, delegation, respect confidentiality, manage risk, report concern related to
safety, remain open while things go in wrong direction, remain trustworthy & honest and maintain
records of own work. However, the ethical principles are required to be focused by medical
practitioners like autonomy, beneficence, non-maleficence, integrity, fairness, loyalty, law abiding,
morale & reputation, privacy of patient, accountability etc.
Apply Law and policy inline with regulatory and ethical requirements in a relevant practice setting.
The policy applied in health care organisation are based on laws and ethical requirements which
direct efforts of carers in correct direction. It includes various laws and ethical principles which are
mentioned here.
Laws applied for policies: This consist number of legislations which should apply in medical
practice setting including Health & Social care act 2012, Access to heath records act 1990,
Access to medical reports act 1988, care standards act 2000, Children act 1989, disability
discrimination act 1995, health act 2009, health & medicine act 1988, health authorities act 1995,
human organ transplant act 1989, mental capacity act 2005 ad many more.
Ethical requirements: The ethical principles are required to implement in healthcare practice
because it helps practitioners to proceed correct activities along with avoiding wrong attempts. It
includes to apply policies to consider ethical factors like informed consent, voluntary participation,
do not harm, confidentiality, anonymity, beneficence, non-maleficence, efficiency, health
maximisation, proportionality and justice while provide care to every person for their better health.

There are several national and international rights of patients law that are responsible for
influencing fair and equal treatment of people in healthcare and support services.
National human rights: According to law of UK, right of patient include
 Consent: A person can refuse particular treatment
 Information: The physician should provides entire knowledge about treatment and related
risk or sides effects to patient.
 Access to treatment: People have a right to use NHS services.
 Standard of care & confidentiality: The professionals should use reasonable care and
maintain privacy of patient data or records.
 Medical records: The patient has aright to see their medical records and ensure their
updation.
 Human rights, discrimination and complaints: Professional should respect private and
family life of an individual and completely eliminate the factor of discrimination while
providing care facilities. A person can put complaints against the hospital and staff and
particular care professional for their wrong attempt.

The legislation is Health and safety at work act 1974 which guide employers to make sure about
overall security of work environment of hospitals to avoid any kind of injury. It includes policies
related to safety fundamental standards such as person centred care, respect & dignity, consent,
safety, safeguarding from abuse, drink & food, equipment & premises, complaints, good
grievance, staffing, fit & proper employees, duty of candour and display of ratings.
