Health care sector is pays a significant role in providing health andd care yto the patient.
The present report will help in understanding the importance of the proper designing of the
organisation and the continuous review which will help the user of health and care in getting
proper services. The report will also discuss the factor and the policies of organisation that can
affect the right of Mr. Albert from getting the proper EAG services.
1.1. How the design and review of services promotes and maximises the rights of users of health
and Social care services.
It is important in health and care sector to take care of the proper well-being and
effective health of people. The design and proper reviewing of the proper services that are being
provided to the patients will help in increasing and maximising the rights of Mr,. Albert in
receiving proper health care in organisational the several design and review system of that help[s
in promoting are as follows:
1. Inspection process: Proper inspection of the working in health and care helps in ensuring
the proper management of the working. It also helps in finding the whether the work is
done as according to the legislation or not. The regulation of CQC is an important which
helps in preventing the people in receiving unsafe care and treatment and also help in
preventing harm and risk of harm (Reeves and et.al., 2011). The care quality commission
helps in observing the care provided by the health care professionals.
2. Accountability: The professional in the health care organisation has to be act in a
particular form that has been sated as per the law. Proper medication to the patients,
proper communicating to the disabled patients is the duty that needs to be properly
designed which is very essential in order to maximise and increase the rights of the Mr.
Albert's in personal care. Proper attitude of the staffs are also required to properly attend
the patients in health and care.

 Disability Discrimination Act 2015: it is a civil law which help in the prevention
of ant type of discrimination against the disabled person in getting proper health

 Data protection act 1998- This is the act that being processed by means of

for the confidentially of the patients. This is helpful for the providing better
facilities to the customers and there must be ultimate care.
 Equality act 2010- This act stated that the care provider should treat all the
patients in the equally manner so that they can have the proper assistance. This
provides a legal framework and it also protects the right of individuals and
provide equal services to all patients.

There are some factors which will influence the organisation in achieving the promotion
and increasing the rights of users in heath and care services. Some of these factors are as follows:
Policies: there are several laws that are affecting the working of the organisation, the policies of
the organisation regarding how the professional will work can affect the right of Mr. Albert in
getting proper health care.
Staffing: The pattern of staffing and organising the working hour of professional will also affect
the proper health care of Mr. Albert (Emmenegger and et.al., 2012). The changes in the
professional make it difficult for Mr. Albert and other patients in getting proper medication on
time. The poor communication skills of the patient also makes it difficult for the users in health
care organisation.

In health are organisation, it is the duty of the professional to have an effective
communication skills in order to make the patients understand and be understood their needs.

INTRODUCTION
Health and social sector plays the essential role in terms to carry out the all the things in
better mode (Worrall and Leech, 2017). Thus, empowering the health sector will helps to build
the greater advantage and this all leads to be in the effective manner. The present report is based
on business activities of Mr Albert. Furthermore, the various things have been covered as
contribution to loss of independence, non participation for the vulnerable people and many kind
of other things.
2.1 Description on factors that may contribute loss of independence, non-participation and social
exclusion for vulnerable people.
There are number of factors and that may be defined in below presented manner as are-
 Independence-Mr Albert was suffering from insomnia and he was having the issue of
sleep disorder. He was very dependent over the medicines and this kind of things has
made him social exclusion from vulnerable people (Kieny and et.al., 2017). The major
dependence of medicine leads to affect the health of the person. Due to it person may get
sleep for long hours and things can made him socially isolated.
 Physical- This is one of the most crucial issue of dependency and social exclusion like
Mr albert. He is having serious issue as insomnia due to it they suffered from sleeping

disorders. Thus, it leads to loss of independence and chances of social exclusion. The
over dependence on medicine leads to affect the physical health of person. Due to it
person may get affected when he does not take medicine.
 Intellectual factor- The intellectual factor affects the medical condition of the people so
that it can be determined by the number of factors. Thus, primary source of this capacity
is mental ability or intelligence of the person.
 Emotional loss- In this, the loss of illness and fear of losing the sadness can create the
negative impact on the health of the person in huge context.

There are number of the ways that can promote the participation and independence and it
has been defined in following context as are-
Empowering individuals- The development and service delivery of the care workers must
be improved with the help of empowering the employee of the enterprise.
Ensuring the performance of individual- With the help of ensuring the performance of the
enterprise cam work as to develop the all the activities in better mode.
Sources of information- The enterprise should work s to provide the all essential
information to the employees so that they can able to feel special in the enterprise and the little
things can be ignored.
There are number of system in place in order to promote the independence. The support
in the health and social care setting, choice and independence sometime can be disregarded.
Furthermore, it can be stated that Staff are required to work within the remit of local policy,
codes of practice, duty of care and their own job role.

In this, the Mr. Albert is suffering from the insomnia and they also suffer with the brain

inclusive of the tension between the care workers and Mr Albert on the safety and independence

education may affect the life of Mrs Albert and it can also hinder the self-respect of the person
and there are following risk factors that has to be defined in following manner as are-
From harm- The better and right education may give the right to the person and it will be

from which they are suffering.
Thus, it can be concluded that organisation has a responsibility in terms to identify and measure
risk in order to complete the risk assessment. The document as hazards can be minimised or

In this, every enterprise must have some policies, rules and procedures to the run firm so that
there can be achievement by the enterprise and it must be set top management authorities. Thus,
they have made some legislation such as the acceptance and unacceptable of the risk, creation of
the better working environment and provide protection from the risk that is not acceptable by the
enterprise. In this, assessing risk, leadership style and procedure all are essential for the
leadership style and promotion managerial risk. Thus, abuse, screening of people who are of
minimise the abuse so that it could be helpful to promote the risk. Duty of care must be
maintained in terms to define accountability within a job role that has been given. To maintain
high standards of care should be presence of clear lines of responsibility so that quality care

and policies and effectiveness of policies are needed to be evaluated.

Thus, in order to run each activity in the better mode there are some wide range legislation
and acts and that all will be helpful in terms to handle the medication of the person suffering
from insomnia. Furthermore, it has been defined in following manner as-
Drug act 2005- It is the act that is concerned with the rules and regulation based on
medication form of drugs. It is very crucial to control the drug based prescription for the patients

suffering from insomnia and this kind of act provides the authority to take the various initiatives
to maintain protection provided by the professional (Tursunbayeva, Franco and Pagliari, 2017).
Medicines act 1968- This is the act that all facilitates with the Basic guidelines and that all
must be used by the care home specifically. It is very essential to control the drug based on the
perception for the insomnia and that must be used in the better mode.
Misuse of drugs- In this, it can be said that penalties being charged for the misuse the
medical drugs for different purpose. This kind of act mainly influence the offences such as
misconducts related to drug management, smuggling of drugs, misuse of drugs etc.

things in the right documentation. Thus, all the thing and medication process are needed to be

Maintain and disposal of medicine- With the help of maintenance of the shortage will be helpful
in terms to taking care of the medicine. Thus, there are number of the disposal policies and this
all are to be used so that expiry date of medicine can be known.
