Introduction
Every business organisation while working must ensure safe working environment as one of the
main tasks for the betterment of employees. A safe working policy of employees helps the
employees to work properly by not concerning their health and safety as the organisation would
consider it on their own. There are various health and safety regulations that are created by the
government of the country to help the employees get better workplace safety (Bragança, and et.
al., 2019). This has been made compulsory by the government to use the equipment so as to
improve the employee's safety at the workplace. Home hardware is an Australian company
which is the third largest retail hardware chain in Australia. Here in this study, a WHS
management system would be created so as to promote workplace health and safety. Also,
evaluation of WHS would be done so as to check if the WHS is done in a better way. While
roleplay would be conducted to brainstorm the employees thinking standards.

The Workplace health and safety act 2011 is one of the important activities that is developed by
the government of Australia. This act is enacted so as to protect the workers and the employees
against the health, safety and welfare by eliminating the risk that is associated with the working
environment of the company (Caskey and Ozel, 2017). The act applies to all the organisation
which are having the number of employees working in the organisation. This act applies both in
relation to the workplace as well as the worker. Hence this is known to be the double jeopardy
case.
As the act also applies to Home hardware hence they have to ensure the ethical work practice
that would help the company to provide the better working experience to employees, workers
and also including the stakeholders who visit the premises frequently. As the organisation is in
the industry where there is a various risk of cutting, moulding, use of heavy machines which are
very risky so as to complete the job. Hence various precautionary methods would be adopted by
the management so as to provide a good and fruitful workplace health and safety structure.
Providing physical safety is one of the main aims of the employer which motivates the
employees to work in a better way. As the current policy of the company includes that providing
their employee's only better equipment's which are less prone to risk. It is required that they
should change their policy so that they are able to achieve the objective of achieving workplace
safety. This is seen that last year the companies lost time to injury was 13.9 which was much
higher than the industry benchmark. Hence this is important for the company to reduce the injury
that occurs while doing the production. Hence it is important to find the area which is causing
injury and to reduce the effects of it.
So the new WHS management structure has various features and structures which can be defined
as below:
The company would introduce the use of machinery for the lifting of heavy outdoor
furniture as it was first done on a manual basis which causes major injury to the

workers. Also, there would be the implementation of the machines in the warehouse
and in the customer service areas.
Also, there would be the implementation of fully automated machines which will
handle the hazardous materials due to which there would be a decrease in the injury.
In the area where the machines are operated, there would be an implementation of the
glass in the boundary which would reduce the risk associated with the injury.
The company should collaborate with the hospitals for quick response to take place at
the time when an injury occurs.
The proposed WHS management structure would provide a rapid response when the injury
occurs while performing their obligations (Castro, Buczkowski and Hafner, 2016). While in the
current structure of WHS there would be more use of machines for doing the hazardous work.
Also, this is seen that in the new system every employee would be provided with the insurance
for a year. Also, a periodic inspection would be done which would showcase whether there is
any type of material lying on the premises which can harm the workers.
This is seen from the previous records that the company is not able to decrease LTIFR which
should be below 10% as standards. The employees should themselves also look before they work
as this would reduce the amount of injury which occurs in the premises of the company.
While on the other hand for making WHS effective management should appoint an external
auditor who will do the audit so as to make the company complied with the rules.

2. How the proposed WHS management system meets legislative requirements.
It is the duty of the manager of the company who defines the WHS to meet the legal
requirements as defined in the act. For the company it is crucial to abide by the laws and to work
according to the legal requirements as if not followed can lead to a decrease in the penalties on
the company. As the law is made for the purpose of the balancing and bringing a nationally
consistent framework so that it helps in securing the health and safety of the workers working at
the workplace (Chapman, and Thompson, 2016). The law provides the guidelines which include
encouraging the unions and the employers to promote the health and safety practice among the
people of the country.
While the person conduction a business or undertaking must take care of the health and the
safety issue of the employees which are associated with it. This is the primary duty of PCBU. As
per section 19, this is the primary duty of the employer to provide health and safety to the
workers engaged in work. As the company is working in the industry where the fixtures, fittings
are its main component hence here section 23 applies on the same. Here the managers have to
ensure that fixtures that are manufactured by them are produced without risk to the health and
safety of the workers. As per section 27 of the act, this is the duty of the managers of the
company to exercise diligence so as to ensure that there is no breach of conditions that are
related to this act. For this purpose due diligence includes taking the steps so as to keep the
employees and the employer knowledge up to date regarding workplace health and safety. This
also includes checking that if there is no instrument that is included in the process of working which may
harm the employee.
Also, the management of the company has decided an approach with the help of which the employees
also participate to reduce the risk that is related to workplace injuries. As this is defined as per section 28
of the act. Where the worker must himself take reasonable care of his health, also he should comply with
guidelines which are specified by the managers so as to promote the health and safety and reduce
workplace injury. This should be the duty of the employer to provide the early rehabilitation to the injured
person so that a critical situation can be handled carefully.
The duty of the worker while working in the company also includes consulting with others. As
per section 46 where there is more than one person in relation to the duty then each person
should consult and cooperate with each other so as to prevent health and safety issues.
Management has also made a structure where they consult with the other workers before
implementing the work to be done. Here they should also check that the relevant information is

management has also decided to employ the health and safety manager who will take care of all

The duty holders are the main and the key person who is responsible for making and

Defining the role of the concerned person would help in the better implementation of the policy
(Farooq, and et. al., 2016). All stakeholders who are concerned with the company has different
roles and responsibilities. These are defined as below:
Roles
The role of Home hardware in the implementation of the policy is that they are able to
promote the health and safety tips in the company. The duty holder should ensure that
there is all the safety kit installed on the premises which are required in case of any injury
that happens. Here the organisation recognises the responsibility to provide a healthy and
safe working environment so that employees do not get any harm. The duty holder is
committed to providing a best in class safety practices to the employees so that they are
motivated towards their work.
Responsibilities and Accountability The duty holder is responsible for organising the safety training of the employees. This is
the responsibility of the duty to the holder to check that all the safety programmes are
implemented are working actively. The duty holder is responsible for consultation with
the employees if there is an issue that is arising while working. The duty holder is
accountable to all the mishappenings that happen in his presence and would be liable to
the penalty. Also, the duty holder has to provide details of all the plan to his manager
every day so that managers are aware of the health and safety guidelines in the
organisation.

4. What human, physical and financial resources are required?
For the implementation of the policy in the structure of the company, it is required to make a
budget that would help in bringing the policy to success. A separate department would be made
which would take care of the policies that are implemented (Hofmann, Burke and Zohar, 2017).
Various resources would be required to implement the Work, health and safety in the
organisation which includes the human resources, physical resources and financial resources.
These resources would be used so as to promote safe working practice in the company.
As the budget for one year has been approved of amount $1Mn. Hence the budget and the

health and safety act. The organisation has implemented the policy which includes providing

the implementation of the machines in the area where there include hazardous work would help
in reducing the casualty (Kramer, and et. al., 2017). Different duty is given to employees so that
they function as per the requirements. Also, the workers are guided to consult with there the
managers before starting the work. The proposed WHS management would help the organisation
in achieving the objective of low LTIFR and would also reduce the cost that is associated with
the casualties that arise in the company. The organisation has allocated the budget of $1Mn for
enhancing the policy of WHS and is working in the best manner for the betterment of the
workers that are working with them. This is seen that in the present policy new devices and the
tools will be installed which would help in reducing the direct contact of workers with the
machines causing casualties.

working environment of the company helps to reduce the implications of these risks. There are
various things that can cause harm to employees. Hence for this identification of the potential
substance is important. It is the duty of WHS consultant which are employed in the company to
identify the harm (Mills, 2016). The procedure that is implemented here is that duty holder
would inspect each and every substance on his own and if finds any of the process incompatible
then troubleshoot them as early as possible. There are checkpoints made by the duty holder
which are performed every time at the start of the day. Also, the duty holder knows the
implications of the hazard if the worker is exposed to an accident. Hence assessing risk is already
done by them. The store has all relevant types of first aid equipment's that would help in tackling
risks. As the manager has identified the risk that is associated with the store hence the control
principles are made which means to eliminate the risk before they happen. For this, they run a
trial run every day.
