Kelson (Pvt Ltd) is a reputed Company registered in the United Kingdom that engages in trade
activities. The company functions within the textile industry and uses a just-in-time system for
purchasing raw materials for production. The profitability of Kelson (Pvt Ltd) is very significant
due to high customer loyalty and suppliers are competing rigorously to secure supply contracts with
Kelson (Pvt Ltd) as a result of its high market share and financial capabilities. Kelson (Pvt Ltd)
recently entered into a written contract with Claudio (Pvt Ltd) to obtain raw materials when
required to match changes in the demand for their products. Due to extensive demand during the
summer 2021, Kelson (Pvt Limited) order raw materials worth hundred thousand pounds
(£100,000) from Claudio (Pvt Ltd) on the 1st of July 2021. Claudio (Pvt Ltd) agreed to supply the
materials on the 5th of July 2021 as per the written contract. However, Claudio (Pvt Ltd) was unable
to supply the raw materials as agreed due to lack of diligence, thus, it was calculated that Kelson
(Pvt Ltd) has lost sales worth two hundred and fifty thousand pounds (£250,000) as it failed to
facilitate the orders that they have received from customers. On the 15th of July 2022 Claudio (Pvt
Ltd) informed Kelson (Pvt Ltd) that they no longer wish to respect the contract it has with Claudio
(Pvt Ltd). Kelson (Pvt Ltd) is seeking your legal advice on possible remedies that they might have
over Claudio (Pvt Ltd). Furthermore, critically evaluate the alternative methods of dispute
resolution that can be used by the aforementioned two parties to settle this issue out of the formal
court system.
