INTRODUCTION
Legislation and policies help in upholding and protecting the rights of both employers, as
well as employees within an organization. If any time there is any kind of disagreement, the
management of the company can refer to the law in order to make a decision (Döring, 2017). If
there is a dispute related to employment rights, the employers as well as employees are expected
to follow a specific process. The report explains importance of receiving a Contract of
Employment and the reason behind why is it important to follow the Equality Act. It also
explains why is it important to follow legislation and consequences of not doing so.
Task 1
Why is it important that you receive a Contract of Employment? Why is it important to follow
the Equality Act?
A Contract of employment can be defined as a contact that is used in labor law and
describes the various rights as well as responsibilities that are possessed by employers and
employees within an organization. An employment contact that is developed carefully and
effectively is not only beneficial for the employer but employees as well. It is important to
receive a Contract of Employment whenever a person gets a job because it protects their job
security from certain specific risks like release of confidential information pertaining to the
employee once the term for employment has ended (Ekmekci, 2017). The contract can include
schedule, general responsibilities, benefits, duration of the employment and other elements. The
contact should be developed according to Employment Act because different countries follow
different Acts and should always be in writing.
The Equality Act 2010 is an Act that protects people from any kind of discrimination
within the workplace. The act has replaced all the previous anti-discrimination laws, making it
easier to understand and strengthen protection in some situations (Equality Act 2010: guidance,
2020). The law explains the different ways in which it is not lawful to treat someone. The
Equality Act covers discrimination against race, religion, partnership, marriage and civil etc.
discrimination can be classified as direct, harassment, indirect and victimization. Under the
Equality Act 2010, employees are protected when they are at the workplace, when they use
public services like healthcare or education, use a transport and so on. This is an important law

because it assigns a duty to all employers to avoid any kind of discrimination among the
employees within the workplace. The Act provides a legal framework to protect the rights of
employees who work in a company.

Why it is important to follow legislation, what would be the consequence if you do not?
It is very important to follow legislation because they not only help in protecting the jobs
of the employees but also protect the company (Feng and Liao, 2016). Following legislation
helps the employees within a company to understand what is expected of them and what will be
the consequences if they violate the same. Legislation within a company defines its culture and if
any person fails to comply with legislation, they will have to face heavy fines for non-
compliance. Individuals might be imprisoned for breaches of the health and safety law with a
sentence of up to six months. This can restrict their overall ability to work within a certain
industry, sector or even travel abroad (Why it is important to follow legislation, 2020). On the
other hand, organizations that fail to comply with legislation at a risk of losing their overall
reputation as well as loyal customers.
Companies are increasingly implementing and complying to laws and legislation in order
to run their business operations successfully. If an organization fails to do so, there will not only
be a decline in its overall performance, but it will also lose out on potential and qualified
employees (Peltier, 2016). This is because they would not like to work for a company that has
had a poor record in the past. There can also be a loss of productivity which can lead to a loss of
profits as well as a sudden decline in the sales of the company. This can further lead to the
company closing or shutting down its operations.
CONCLUSION
From the above report, it can be concluded that legislation and policies help in
safeguarding the rights of the employees as well as employers in a company. A Contract for
Employment describes the rights possessed by employers and employees in a company, whereas
the Equality Act 2010 protects them from any kind of discrimination. Also, all organizations
should follow legislation because not doing so can have negative consequences for them.
