TASK 1
the case shows that a Dylan Sturt murders his girlfriend Caitlin O’Brien with a pillow and
stabbed her many times. He then walked into police station and surrendered (Murder case study,
2019). Also, he started pleading in front of police. In Melbourne court he was felt guilty of
killing her.
Here, police investigated crime by visiting the house of Sturt. they found the body lying on
bed. after that police started questioning neighbours about the incident happened. then, they
searched for pair of scissors in the house. after that, Facebook chat was checked of both as they
exchanged some messages (Lochner, 2020). Then, at last questioning was done with Sturt
regarding murder.
there were several challenges faced by police. first is they did not find any proof that
Sturt has killed Caitlin. also, they believed that he was suffering from mental illness and due to it
murder was done. so, it was not easy for them to collect evidence.
TASK 2
From the case it is said that the police evidence was irrelevant. it is because as per
Evidence act of 1995 (Evidence act, 1995) it states that there are certain rules to be followed by
state police before they apply to laws of evidence. So, photographs taken by police was from
camera of bank and no officer was concluding about it. Therefore, this evidence can not be taken
as opinion or admission. moreover, photos taken was tendered. thus, there is no proof of bank
robbery.
