Introduction
The following discussion is based on different case study suggesting different scenarios
that can take place between the tenants and the house owner. The laws and legal rights protecting
every party in case of damage or other unfortunate situations are being discussed in details.
Case 1
Question 1. Explain the legal principles involved in the following given case scenarios.
The principle is based on the paperwork. If the paperwork is not correct, the couple is
having no authority to stay in the premises. Melissa has all the right to make them vacate the
property with legal procedure as per the standard states. The rent must be paid on the first day of
every month or every term until and unless the lease papers say anything else on it. Failure to
pay rent for more than three weeks, the tenant has all the right to provoke the lease
(Thistlethwaite, Henstra, Brown & Scott, 2018, p. 203).
Question 2. What rights does Melissa have and what actions can she take and explain the
obligations of David in this scenario?
According to Head, & Lloyd‐Ellis, Melissa can give the tenants a legal notice demanding
them to leave the premises as soon as possible. David can continue to stay there only if he pays
the rent cost along with interest. David is obliged to pay the price plus attention on the rented
property (2016, p .1380).
Question 3. Highlight the expected results of this scenario by using specific rules and laws.
The most likely scenario is David has not paid the rent and asked to leave the premises as
per the order of Régie du logement. A form of N4 will be given from Melissa to David to end the

tenancy agreement. If the amount was small then by calling 211 websites, they can enroll
themselves into the program and stay away from becoming homeless. Alternatively, they can pay
the rent plus the interest and make a settlement with the property owner (Brown, 2017, p. 734).
Case 2
Question 4. What rights and obligations are available for both parties?
Mr Justin could get away with this problem if he had paid the necessary amount of
security deposit. The landowner cannot sue Justin if his deposit covers the amount of property
damage. However, if in case it does not includes the damage then Mr Bob has the rights to sue
Mr Justin for the money.
Question 5. Is Mr Justin liable for $1324.21? If not, how much amount is Mr Bob entitled
to retain and how to deal with the balance amount?
No, Mr Justin is not liable to $1324.21 to Mr Bob. However, he should pay the amount of $597.5
to Mr Bob because the carpet has already been used for two years. The price of the rug is $537.5,
and the cost of a houseplant is $60 ( Hughes, 2018, p.21).The balance amount should go under
the depreciation of the asset.
Case 3
Question 6. Who would be responsible for the fire and what are the remedies available to
another party?
The property owner is very much responsible for the fire and has no right to ask for any
compensation. The other party can move out from the house stating the starting agreement does
not stand between the two parties any further (Freeman, 2017, p. 299). As the home is being
destroyed the tenant does not have to pay any more rent but should move out of the house.

The house owner is responsible for repairing the damaged property.

If the tenant paid for the repair, then the property owner is obliged to pay. However, if the
tenants caused the damage, then it is the right of the owner to make the tenants pay for the repair.

The above study provides a close look into the different scenarios that might take place
between the two parties regarding a property lease. The laws and legal rights protecting every
individual regarding the matter in hand are being discussed. The different case studies are
